Obama’s Gun Grabbing Executive Order Break Down

Anchorage, AK --(Ammoland.com)- Sorry this is such a long article but we feel it’s important to take a line by line look at President Obama’s gun grabbing Executive Order list.

Here are some highlights followed by a line by line analysis.

These orders grow government, tracks all Americans and invades privacy contrary to our rights under the 4th amendment.

This imposes unnecessary involvement in the free market by government employees with no knowledge or expertise in the field.

Last minute additions to Address Mental Health issues are really are non-actions. Completely fails to look into the link of violence acts and psychotropic prescription drugs.

This is an attempt at data mining and solidifying Obamacare. This is the precursor to registration and identifying gun owners. It will create new categories of citizens prohibited from owning arms.

1.     Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.

What is considered relevant data? The answer is all data the administration considers relevant. Your medical records once private, will now be made available to law enforcement. This privacy intrusion affects everyone. This is data mining.

2.     Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, which may prevent states from making information available to the background check system.

What are unnecessary legal barriers? The answer is any law deemed unnecessary by the administration. This assumes the president has sweeping power to ignore existing law. It encourages law enforcement to ignore principles of privacy and violate the 4th amendment.

3.     Improve incentives for states to share information with the background check system.

Translates to pay or withhold funds to “encourage” the states to invade the privacy of citizens.

4.     Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.

A review is simply a review no problem. What could be a problem are the recommendations coming out of such a review such as an expansion of gun prohibitions by regulation.

5.     Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.

What are the proposed rules? Guns secured during a traffic stop or police interview, could be seized and not be given back without a background check even on people who have already passed such a check. This will place the firearms owners’ property rights in a new category. It is an incremental step toward justifying confiscation. In our society a person is supposed to be presumed innocent until proven guilty however this assumes one guilty until proven otherwise.

6.     Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.

This opens the door to mandatory checks on private sales and eventually the ban of private sales except through a dealer.

7.     Launch a national safe and responsible gun ownership campaign.

Great Idea but who determines what is safe and responsible? I propose we start a campaign to get the NRA educational courses back in schools and start marksmanship programs.

8.     Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).

Safety? Gun safes and locks are not dangerous. Perhaps construction standards review would be more appropriate. This could be an opening to requiring your arms be locked up at home. How about personal responsibility as the guiding principle?

9.     Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.

Guns cannot be traced without universal gun registration of firearm and their owners. We have seen what happens when such information is collected; it is available through government agencies and published under the FOIA, invading our right to be secure in our possessions. Why waste valuable law enforcement time with mandatory regulation that should be decided by the officers doing the investigation.

10.  Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.

 No issue. Lost and stolen Guns should be returned to their rightful owner’s promptly.

11.  Nominate an ATF director.

No issue it just gives the illusion of doing something. Perhaps a better recommendation would be to abolish ATF.

12.  Provide law enforcement, first responders, and school officials with proper training for active shooter situations.

A good step if it includes offering firearms training to all the above.

13.  Maximize enforcement efforts to prevent gun violence and prosecute gun crime.

All laws should be enforced. Bad laws should be changed. Beware of creation of new laws specifically aimed at firearms abuses. They can easily become oppressive to firearms possession.

14.  Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.

Guns are not a disease. This is nonsense. This is a thinly disguised attempt to create more categories of people prevented from owning arms. The CDC has had a long history of anti-gun bias. If they were going to do something productive it would be a study on the link of violent acts and psychotropic prescription drugs.

15.  Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.

Education is good, but the experts are in the industry already offering technology to their customers. The Attorney General office is not a qualified expert in Gun safety technologies. It’s a concern about what kind of regulations they are going to mandate.

16.  Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.

They can ask but by Law they cannot collect or maintain such information this order encourages Doctors to violate the law.

Title X—“Strengthening Quality, Affordable Health Care for All Americans”  line 23 of page 2,037, they would learn that databases regarding ’’(A) the lawful ownership or possession of a firearm or ammunition; (B) the lawful use of a firearm or ammunition; or (C) the lawful storage of a firearm or ammunition” can neither be created nor maintained.

17.  Release a letter to health care providers clarifying that no federal law prohibits them from reporting threats of violence to law enforcement authorities.

No issue unless worded improperly. Doctors have always followed their conscience. Will government agencies issue a list of comments that should or must be reported? This is another case of government encouraging citizens to spy on one another.

18.  Provide incentives for schools to hire school resource officers.

No issue here except a financial one. This seems to accept the NRA’s position of putting cops in schools. The best solution is encouraging the citizen to exercise his constitutionally guaranteed right to bear arms. Include teachers to end the “unarmed” victims in “gun free killing zones”.

19.  Develop model emergency response plans for schools, houses of worship and institutions of higher education.

Providing Education is good however these plans should never be forced on an institution. See item 18.

20.  Release a letter to state health officials clarifying the scope of mental health services that Medicaid plans must cover.

Clarification is good.

21.  Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.

Clarification is good.

22.  Commit to finalizing mental health parity regulations.

This seems to be an empty promise to act. No order was need to tell the administration to do their job.

23.  Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health

Not sure what if anything this means other than “let’s talk” which means compromising away our rights.

 

In summation, today the president has grabbed every right of American citizens he thinks he can get away with.
