Court Rules Off-The-Grid Living Is Illegal

Living off the grid is illegal in Cape Coral, Florida, according to a court ruling Thursday.

Special Magistrate Harold S. Eskin ruled that the city’s codes allow Robin Speronis to live without utility power but she is still required to hook her home to the city’s water system. Her alternative source of power must be approved by the city, Eskin said.

As previously reported in Off The Grid News, Speronis has been fighting the city of Cape Coral since November when a code enforcement officer tried to evict her from her home for living without utilities. The city contends that Speronis violated the International Property Maintenance Code by relying on rain water instead of the city water system and solar panels instead of the electric grid.

“It was a mental fistfight,” Speronis’ attorney Todd Allen said of Eskin’s review of his clients’ case. “There’s an inherent conflict in the code.”

Part of the conflict: She must hook up to the water system, although officials acknowledge she does not have to use it.

Speronis told Off The Grid News in February she hopes to win her case and set a precedent for others in her situation. After court Thursday, Speronis told Off The Grid News that she actually won on two of three counts, although she acknowledged her legal battle is far from over.

“But what happens in the courtroom is much less important than touching people’s hearts and minds,” she said. “I think that we are continuing to be successful in doing just that and I am so pleased — there is hope! [Friday] morning, as I took my two hour walk, there was a young man, unknown to me, who drove by me, tooted his horn and said, ‘Robin, congratulations on your victory yesterday, keep up the fight and God bless you.’ That is beautiful.”

Magistrate Admits Code is Unreasonable

Eskin spent several hours reviewing the case and admitted that the code might be obsolete, the local Press-News newspaper reported.

“Reasonableness and code requirements don’t always go hand-in-hand … given societal and technical changes (that) requires review of code ordinances,” Eskin was quoted as saying.

Eskin’s remarks indicate that he views the code as both obsolete and unreasonable and in need of change. Yet he felt he had to enforce it.

The city did overstep its authority and may have violated due process procedures, Eskin noted. He felt that the city had not given Speronis proper notice of violations and ruled that some of the charges against her were unfounded.

“I am in compliance,” Speronis told the News-Press. “I’m in compliance of living … you may have to hook-up, but you don’t have to use it. Well, what’s the point?”

Case is Unresolved

Speronis disconnected all the utilities from her modest home in Cape Coral for an experiment in off-the-grid living some time ago. City officials ignored her activities until she went public and discussed them with Liza Fernandez, a reporter for a local TV station. A code enforcement officer designated Speronis’s home as uninhabitable and gave her an eviction notice a day after the piece aired.

The widow and former real estate agent now has two choices. She can either restore her hookup to the water system by the end of March or appeal Eskin’s ruling to the courts.

It is not known what action the city will take but city officials told Fernandez that they would be willing to let Speronis stay in her home if conditions are “sanitary.” At the hearing, Eskin noted that city officials have not actually been in Speronis’s home to make that determination.

The International Property Maintenance Code is used in communities throughout the United States and Canada. The code states that properties are unsafe to live in if they do not have electricity and running water. Speronis has electricity and water. She gets running water by collecting rainwater and electricity from solar panels.

      1. Hook the inverter into the 110 and charge them for the use of your power.
      2. Tell the power and water company your going on a 1 year vacation, moving to a new country, etc
      and turn everything off.
      3. You are now off the grid officially.

      4. When all fails. Do not pay your utility bills, because Obamacare is to expensive and you cant afford to live anymore, and I will promise you they will shut them off for you at no cost. I know. :) .

        there is a monthly administration fee, ANY fees that go unpaid trigger a lean on your property. By the time the property sells or is left to family, the fees and penalties will eat up any possible profit for the seller. Hooking solar to the grid is a good idea but the whole water fiasco could be the downfall. I thought I read that she was hooked up to water but just disconnected from it. Not sure how she disconnected…..hmmmmm
        we are very interested in these issues, as we are selling our home and looking to go as far into the wild as possible. Funny, for thousands of years people and communities have lived healthy, clean lives with out our damaging, irresponsible, inefficient system and people have still seemed to thrive and multiply much more than the elite approve of. They want us dead. This is all about control. If they do not dry up every cent of cash you make, you might have money to support a good candidate, or another cause they don’t like. You won’t spend your money properly if you are allowed to have it, that is why they must take it and give it to the right causes.

The government will penalize/charge unreasonably an american for producing carbon dioxide AND penalize/charge unreasonably for NOT producing carbon dioxide……can you say DIVISIVE ?! Our governments just want us destroyed. They will make any choice illegal. She risks inspiring others to choose better, for themselves and the environment, which means less money for state, federal and local governments that are failing from incompetent management.

      Everyone seems to have great answers for ‘fighting city hall’ here, but why not just do the obvious – MOVE TO ANOTHER TOWN OR STATE? Why live in a town that doesn’t like you, will fight you, wants to sue you, and won’t leave you be? If EVERYONE voted for companies with their purchases, voted for the party platform and the politicians’ standpoints (instead of race, hair color, etc.), and voted with their residence for the town, county, state that they like – YOU WOULD QUICKLY CRUSH THE SOCIALIST HELLS in America, because they would look like NYC’s slums. Lots of ‘gimme more entitlements’ welfare children, few job-holding middle class to pay the actual tax bill to finance it.

      If they make you hook up city water just to live in your house per civil order, then do it, but that does not mean you can not still fight it in court. Just watch your water bill. Most in S.W. Florida have been overcharged (always an accident,they say). Your bill should read zero, and the taxes attached should be deferred.

      When I walked away from my CA home and let the bank have it, I had all utilities shut off.
      It came as a surprise to me that they would not turn off the water (sewer) and continued to bill me in the other State that I moved to.
      I had forwarded all my mail to a PO Box. The bill finally stopped coming once they foreclosed on it. It transferred to the new owner as past due.
      P.S. No I did not have to pay them back for the home loan, just put a dent in my excellent credit. :lol:

        You have a hometown in which you vote. You also most likely have a community planning agency of “some kind.”

        THAT is where these problems originate. Codes that demand house look exactly the same, …..and maintain the same standards……..

        all end up making these kinds of laws.

          I have spent years working for civil engineering firms and you are correct. It is a local code enforced, by local people, who are just plain local. Could be some of the agenda 21 madness.

          Thanks for showing up. Yes, local agencies and Historic preservation societies are the main culprits. But certainly not the only ones. City governments will also implement these laws in order to “Commandeer” properties for the city.

          I have witnessed this with my very own little peepers.
