California Warns Citizens: You Better Buy Your Guns Before Jan. 1

LOS ANGELES — Many popular guns, including specific semiautomatic rifles and pistols, will disappear from California gun stores on New Year’s Day 2017, the California Department of Justice Bureau of Firearms is warning gun owners.

The bureau recently sent out a notice to firearms dealers detailing which weapons will be banned beginning Jan. 1.

It is based on a new law – S.B. 880/A.B. 1135 – that bans “bullet button” firearms and redefines what is an “assault” weapon. The law allows persons with such guns to keep them, but only if they are registered.

The National Rifle Association is telling California gun owners that because of the 10-day waiting period, the purchasing “process must be started no later than December 21st.”

The Bureau of Firearms is warning dealers and gun owners that there will be no exceptions. Its memo says “URGENT AND TIME SENSITIVE.”

“Effective January 1, 2017, ‘Bullet Button’ firearms will be considered assault weapons,” the memo reads. “… The dealer will NOT be able to deliver the firearm after December 31, 2016, regardless of the circumstances.”

The law was signed by Governor Jerry Brown during the summer. At the time, Amy Hunter, a California spokesperson for the NRA, told The Los Angeles Times that Brown had “signed a draconian gun control package that turns California’s law-abiding gun owners into second-class citizens.”

The law was passed in the wake of the December 2015 San Bernardino mass shooting.

“The governor and Legislature exploited a terrorist attack to push these measures through even though the state’s already restrictive laws did nothing to stop the attack in San Bernardino,” Hunter said.

Here are the features that will make a gun illegal to sale in California on January 1, 2017, according to the Bureau of Firearms:

Rifles

A semiautomatic, centerfire rifle that does not have a fixed magazine but has any of the following

• A pistol grip that protrudes conspicuously beneath the action of the weapon.
• A thumbhole stock.
• A folding or telescoping stock.
• A grenade launcher or flare launcher.
• A flash suppressor.
• A forward pistol grip.

A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.

A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.

Pistols

A semiautomatic pistol that does not have a fixed magazine but has any one of the following:

• A threaded barrel, capable of holding a flash suppressor, forward handgrip or silencer.
• A second handgrip.
• A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning the bearer’s hand, except a slide that encloses the barrel.
• The capacity to accept a detachable magazine at some location outside of the pistol’s grip.

A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.

Shotguns

A semiautomatic shotgun that has both of the following:

• A folding stock or telescoping stock.
• A pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, or vertical handgrip.

A semiautomatic shotgun that has the ability to accept a detachable magazine.

Any shotgun with a revolving cylinder.
