Think about this. All of us Army retirees receive a newsletter titled ‘The Echoes Newsletter’, containing news about and for retirees. The latest issue has a half page article directed at us. It was a reminder that we retirees are still subject to the UCMJ (Uniform Code of Military Justice). The article explained that if we violate something in the code we can be recalled back to active duty and be Court Martial. I find the timing interesting. Could it be that they are afraid of us. All we’re doing is trying to uphold our Oath and exercise our Constitutional Rights.

        Even how at the State of the Union. The soldiers had to remove the bolt carrier or something like that from their weapons.

        Apparently a few sources have said the higher up’s even a couple Generals and like the CIA / FBI directors do not go around armed soldiers.

        They only allow the Secret Service or the merc’s like blackwater to be armed around them. That says a lot to me, actually gives me more faith that our troops will do whats right when the time comes.

        Every time i watch C-Span I can almost feel the fear coming through TV.

      the law applies to everyone =. there is one set of laws that everyone must be treated = under. it includes the constitution and other non-contrary non-hypocritical laws. there isnt 2 sets of laws, there isnt one for the mlitary and one for everyone else, everyone must be treated = under the laws.

        Completely different set of rules for the active, reserve and retired members of the armed forces. They must follow the civilian “laws” and must also act in accordance with the laws and orders of the US Armed forces.

        (Hint: in locations that are not in the boundaries of the US, rule of law is still required.)

      That won’t hold up in any court. If they try that crap we pull full disclosure on them. It’s a bully tactic and will not work. Being in the military is a contract with a private army from D.C. Being military is touted as “serving your country”, but you’re really serving the corporate interest that sit in D.C. These people are getting scared and trying everything.

        For clarity…Washington was defeated. A sick army and no food or medicine. He crossed the river and met a well rested army of soldiers. He was a coward and traitor. The government was established and the traitors allowed to reap the spoils. Our people and land defeated and taken into slavery. You are just still so blind as to not realize what all you have been lied to about. Your past. Your ancestors. Even your history less than 20 years ago is manipulated.         Thank goodness we can fish…. Is that the freedom? I had to get a $30 license. Then a Park permit for $40. Then fishing stamps for ten. I have limit and size that would not feed my family. Freedom is good for business for sure..

      I would much rather face a GCM than some corrupt civilian trial. The trail rules for a courts-martial are much more fair, leave little for interpretation and are written so as to favor neither the defendant nor the government.

        Did You Know? Retired Soldiers and the Uniform Code of Military Justice
        WASHINGTON — Have you ever heard a retired Soldier say, “They can’t touch me now; I’ve retired.”? Fortunately, for the sake
        of military justice, this is not true when it comes to retired Soldiers who violated the Uniform Code of Military Justice (UCMJ)
        while they were on active duty or in a retired status.
        Under Article 2 of the UCMJ, the Army maintains court-martial jurisdiction over retired personnel. Army Regulation 27-10,
        Military Justice, states “Retired members of a regular component of the Armed Forces who are entitled to pay are subject to
        the provisions of the UCMJ . . . and may be tried by court-martial for violations of the UCMJ that occurred while they were
        on active duty or while in a retired status.” Department of the Army policy, however, does limit these trials to cases where
        extraordinary circumstances are present. The Army normally declines to prosecute retired Soldiers unless their crimes have
        clear ties to the military, or are clearly service discrediting. If necessary to facilitate courts-martial action, retired Soldiers may
        be ordered to active duty.
        The regulation adds that “Retired Reserve Component Soldiers are subject to recall to active duty for the investigation of
        UCMJ offenses they are alleged to have committed while in a Title 10 duty status, for trial by court-martial, or for proceedings
        under UCMJ, Article 15.” Forfeitures imposed under the UCMJ, Article 15 may even be applied against a Soldier’s retired pay

      This article is flawed and here is the reason why,

      lets say you joined the Armed Forces, you did your time and left the service. the amount of ready reserve time is equal to the amount of time you served in the military lets say you spent 6 years in the Air Force you still own 6 years in the ready reserves after that time has expired you are free.

      if you retired from the Military you are still obligated to the ready reserves for 6 years.

      if you, as a military retiree stay in and retired at your high year of tenure.

      Here is an example, lets say, you are a MSgt in the Air Force and you retired at your High year of tenure which is 24 years. But you can be called back into uniform for a war ( a meat grinder of a war)

      but you would be the last to be recalled back into the services. if you have a disability rating from the VA which is related to your time served in the military.

      You would be the last person to be recalled back into the service.

      this info is as current as of 2001 I’m sure this may have changed since 2001.

      Oops, looks like Wikipedia confirms the basis of this article. Hence the following about the UCMJ jurisdiction:

      Persons covered include: Retired members of the uniformed services who are entitled to retirement pay are also subject to the UCMJ, as are retired reservists who are receiving hospital care in the VA system.

      One of the articles for which you can be prosecuted:

      Contempt towards officials is addressed in the Punitive articles, specifically Article 88 of the U.S. Uniform Code of Military Justice in the Manual for Courts-Martial (MCM), United States (2008 Edition) as follows:

      “ Any commissioned officer who uses contemptuous words against the President, the Vice President, Congress, the Secretary of Defense, the Secretary of a military department, the Secretary of Transportation, or the Governor or legislature of any State, Territory, Commonwealth, or possession in which he is on duty or present shall be punished as a court-martial may direct.

      couldn’t find anything more than what’s said here, but have talked to service men and they tell me things are getting wierd in the service so kind of believe this.

      Congress has been trying to big in a recently retired US Army Colonel to question him about Benghazi, the military is stone walling saying they have no control over retiree’s. Beware this administration can say anything they want, they literally do anything they want because no one will stand up to them. You can not be reactivated just to be charged with a crime, but then anything is possible with this band of Marxists and a military officer corp who only worries about them selfs.
