Federal Judges Allow Perjury In Court To Oust Poor Self-Litigant!

      News out of Texas indicates at four or more federal judges allowed known perjurous affidavit testimony in court against a poor self-litigant formerly working for a large, popular non-profit organization, the YMCA of Greater Houston.  The district  magistrate ruled in favor of the YMCA, the defendent, against the pro se plaintiff in a summary judgment motion, thus putting him out of court without him ever seeing a jury.  This seems to be a direct affront to the U.S, Seventh Amendment, which gives citizens the right to a trial by jury in civil cases involving a dollar-value of $20 or more. 

     

      Documents indicate this all was done despite what seems to be multiple legal precedents in the man’s favor, including from the U.S. Supreme Court and the 5th Circuit Court of Appeals (which had appellate jurisdiction). Additionally, the standard legal parameters for summary judgment cases seem to have been grossly tossed aside as well.  Very interesting facts are emerging that show possible evidence of multi-tiered corruption.

      One aspect of this is documentation of quite apparent false testimony given to a Texas labor official via YMCA counsel, after which logsheets show the TWC (Texas labor board) soon advised closure of the case without questioning YMCA witnesses.  TWC then transferred the investigation to the EEOC, which records indicate did nothing other than follow their recommendations, also without questioning witnesses. 

      Further documentation seems to verify proven perjurous affidavit testimony was given and permitted in court as evidence for the YMCA and that it was cited in dismissing the man’s case from court, despite the court’s knowledge that it was untrue testimony.  Whether top YMCA officials knew the testimony was false or not is unsubstantiated.  This is all very troubling, however, and is not mere rumour, as documents involved show U.S. court identification coding indicating the documents are from court records as high as the U.S. 5th Circuit Court of Appeals, where Mr. Noack also apparently failed in his attempt to get the perjury-tainted ruling thrown out as well as intervention regarding claims of evidence-tampering and a refusal of the lower court to enforce partially-unfulfilled judicial orders that the YMCA disclose evidence of possible wage-discrimination.

       Mr. Noack recently spent his fifth consecutive Christmas living in tents after his departure from the YMCA, where he worked for over 8 years.  (A photo of one of his tents is shown above.)  He was involved in various aspects of childcare for the YMCA and eventually seems to have become a fulltime employee, working as a multisite director over several afterschool programs.  Noack’s lawsuit included claims of being ordered to discriminate against men and african-americans, claims of retaliation after allegedly refusing to work unpaid overtime and after refusing to discriminate, and even a series of emails used as evidence showing Mr Noack apparently explaining his unwillingness to practice discrimination shortly before his YMCA job ended, plus many more documents.  Some of the documents described can be found online on sites called Supremely Unjust and Still Supremely Unjust.

      Additional statements in the case seem to show Mr. Noack alleged massive unpaid overtime, multiple physical assaults against himself, reverse gender-discrimination in various forms, and included sworn testimony that his supervisor once spoke out loud that she hated men.  At least one U.S. Congressman seems to have copies of implicating documents and is said to have begun a govt. inquiry.  Considering the encroachment on Mr. Noack’s Constitutional rights, the apparent lack of due process – Noack apparently was not allowed cross-examination while deposed - plus corruption through perjury and other factors, it should seem important to all U.S. citizens to make this a hot topic with Congressional members and the Executive branch of govt.  Calls and emails can have a resounding impact on federal officials, and Americans absolutely need to assert their voices to wholly retain their Constitutional rights and to denounce possible workplace bullying, violence, discrimination, etc.
