It’s a baffling question: can you carry CBD oil during your travel in the US or not? 

It’s even more puzzling to connect with the laws (pertaining to CBD) in the country since every state has one, or many of its own.

This means that out of the 50 states of the USA, you might or might not get arrested for carrying CBD with you. 

As per 2018 Farm Bill, hemp-driven CBD is legal in all 50 states, but marijuana-derived CBD isn’t federally legal. Anyway, it’s time to throw some light on our main topic of discussion today—can you travel with CBD oil in the USA?

Can you fly with CBD oil?

As per Harvard Medical School, CBD oil has proven to be quite useful in the treatment of anxiety, depression, insomnia, weight issues, pain, and inflammation. It is a super-supplement that has countless medical benefits. 

So, can you fly with CBD oil? Let’s see.

Recently, the Transportation Security Administration (TSA) updated its website about travelers carrying CBD oil for medicinal purpose in checked and carry on luggage. It says that hemp-derived CBD oil can be carried on a plane but there are certain requirements that need to be met.  

However, no clarity has been given about these requirements, not yet. Since many states in the USA still haven’t embraced the Farm Bill completely, the TSA officers enforce local law of the state, which also includes totally disregard medical purpose, even attached doctor’s subscription. 

In a recent Instagram post, TSA wrote, “Let us be blunt: TSA officers DO NOT search for marijuana or other illegal drugs.” 

Additionally, they also clarified that getting caught with marijuana-driven CBD oil doesn’t mean that you will be straightaway arrested or prosecuted. It solely depends on the state you are traveling to. 

For example, if you are in Oregon, where cannabis is legal, you won’t run into trouble. However, in states where it is still a crime, there are chances of certain legal enforcement.  

In a nutshell, you are allowed to travel with hemp-induced CBD oil. However, flying with marijuana-derived CBD oil remains illegal. The reason for this is that hemp is known to have less THC than marijuana. THC is primarily the constituent that puts a person ‘on high.’ Thus, legal prohibition.

Can you travel by ship with CBD oil?

You might have problems if you carry CBD oil on a ship or cruise in the US. CBD oil is strictly prohibited in cruises. Carnival Cruise has clearly laid out their deal—they forbid CBD or any other form of cannabis. The Royal Caribbean Cruise doesn’t allow “any cannabis-derivative products (including CBD products). 

Even Disney Cruise Lines do not allow its passengers to carry any amount of cannabis, which includes CBD oil as well. The reason for such restriction is that these ships or cruises are referred to as public land and thus, federal laws are applied to them. 

The most likely option for you is to carry hemp-driven CBD oil, and that too is limited to certain restrictions. If you think that it would be child’s play to squirrel away with it, or hide it somewhere down in your luggage, be very aware that, if you are caught carrying the same in your stuff, the repercussions might be ghastly.

For safe side, do your own research about the laws (related to cannabis) of the state you are traveling to. However, the best thing would be to leave your CBD oil at home. 

How to keep up with the law when you’re traveling with CBD?

To stay out of trouble, the first advice for you is to not bring any cannabis along when you are traveling.

However, if it is a must for you to bring it along, for reasons, such as anxiety or inflammation, then there are a few steps you can follow to stay safe and away from all the possible troubles. 

To begin with, you can research about the certificate of analysis of your product (when you are carrying hemp-induced CBD) and keep a print out of the report that confirms its THC level. In case, a TSA officer finds it in your luggage, then show the same to him. It might just save you!

If you are traveling overseas, then chances are that there would be higher penalties for carrying CBD oil. So, it’s best to not bring either hemp-derived or marijuana-derived CBD oil with you. If cannabis isn’t legal in the country, then you might get into a lot of trouble. 

If you suffer from traveling anxiety, then it is advisable to use the oil before you leave home. You’d feel calm for at least during some hours of your travel.

If you already have CBD oil at home, or even if you don’t, you can get the same delivered to the hotel, or wherever you plan to stay during your travel. 

If you’re using CBD oil for medical purposes and have a subscription from your doctor, remember to keep it with you. It might come handy at the time of checking.

Before you travel, make sure that the THC level of your CBD oil is below .3%, and is extracted from hemp and not marijuana. 

Do not forget to do your research about the state laws of the destination you are traveling to. This will help you to stay acquainted with the laws and save you from getting into unnecessary difficulty.

Lastly, when TSA officer questions you about the contents of your luggage, be extremely confident in telling him about why it was necessary to bring the CBD oil with you!

Even though a lot of confusion about traveling with cannabis has been cleared by the US state laws, yet many questions about the usage of CBD hover around people’s minds. 

There are still many other queries that need to be cleared, and hopefully, will be, in future. For now, we can responsibly and legally enjoy the pragmatic effects of CBD.
