What purpose does a body of laws intended to restrict the powers of government serve, when the government completely disregards those laws, and the citizens do nothing to stop it?
Law becomes pointless the moment it stops being enforced.
On March 19th, Barack Obama authorized military action against Libya in conjunction with an international coalition. The problem is, Barack Obama did not have that authority.

Military action is nothing more than a euphamism for war. And the authorization of war lies solely in the hands of Congress.

Article I, Section 8, Clause 11 of the United States Constitution, sometimes referred to as the War Powers Clause, vests in the Congress the exclusive power to declare war, in the following wording:
[Congress shall have Power...] To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water.Further, the War Powers act of 1973 clarified these powers of congress to declare war.

The War Powers Resolution of 1973 was a United States Congress joint resolution providing that the President can send U.S. armed forces into action abroad only by authorization of Congress or in case of “a national emergency created by attack upon the United States, its territories or possessions, or its armed forces.”

“And so, nine days ago, after consulting the bipartisan leadership of Congress, I authorized military action to stop the killing and enforce U.N. Security Council Resolution 1973.”
Notice in the above quote who authorized this military action. But, this transgression of the law is rather minor compared to news coming out of Libya the past few days. It seems America has just found itself in a serious constitutional crisis thanks to the actions of Barack Obama, and treason is on the lips of Americans today.
Obama seems to have acted in a rather hasty manner in this war, dragging America into another country to further it’s own interests. But who are we helping in Libya?

Abdel-Hakim al-Hasidi, the Libyan rebel leader, has said jihadists who fought against allied troops in Iraq are on the front lines of the battle against Muammar Gaddafi’s regime. Mr al-Hasidi admitted he had earlier fought against ‘the foreign invasion’ in Afghanistan.
Do you understand the seriousness of this admission?
Libyan rebels, on the front lines fighting against Gaddafi’s regime, previously fought AGAINST American troops in Iraq! What’s more, the leader of the rebels in Libya admitted that he himself fought against America in Afghanistan! And these are the people that Obama has sent our military in to help overthrow the Libyan government! These are the very same people we have been fighting against for the past 9 years. These people are members of the very same group who has been blamed for the attack on 9-11-01 for God’s sake! This is Al Qaeda that Obama is helping in Libya!
I want to be very clear on this here, our military is currently being used to support and aid our enemy’s efforts to overthrow the government in Libya, thereby giving them safe-haven, increasing their military power via Libyan arms, and almost inevitably allowing them to procure the powers that come from being the ruling party of an entire country! Obama is in effect enabling Al Qaeda to position themselves to set up an extremist Islamic regime in the wake of the power vacuum created by the fall of Gaddafi, which will most certainly become a sovereign sanctuary and training ground for future generations of Islamic terrorists hell-bent on destroying “The Great Satan”.
This, my friend, is treason. By the very definition of the word, this is treason. In fact, it is this very KIND of treason that our constitution defined as one of the most serious acts against our country.

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort.
Now, the KEY WORD in the above definition is “OR”. Obama’s actions are completely consistent with the latter part of this definition. It is well established that Al Qaeda is our enemy. And it is now public knowledge that the people Obama is helping in Libya are in fact, Al Qaeda. Obama has adhered to, or supported, America’s enemy, by giving them aid: Enforcing the no-fly zone via bombing Gaddafi’s air defenses; AND comfort: through eliminating Gaddafi’s ability to strike the rebels from the air, where they were unable to effectively defend themselves.
And all this was done, not by the explicit authorization of congress, as the law requires, but by the permission of a foreign power, and ON HIS OWN AUTHORITY!
For the first time in history, a president has disregarded the constitution, circumvented congress, and acted on the orders of a foreign power to support, aid, and give comfort to an enemy of The United States of America.
Make no mistake, THIS IS TREASON.

In what circumstances, if any, would the president have constitutional authority to bomb Iran without seeking a use-of-force authorization from Congress? (Specifically, what about the strategic bombing of suspected nuclear sites — a situation that does not involve stopping an IMMINENT threat?)
“The President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation.
As Commander-in-Chief, the President does have a duty to protect and defend the United States. In instances of self-defense, the President would be within his constitutional authority to act before advising Congress or seeking its consent. History has shown us time and again, however, that military action is most successful when it is authorized and supported by the Legislative branch. It is always preferable to have the informed consent of Congress prior to any military action.
As for the specific question about bombing suspected nuclear sites, I recently introduced S.J. Res. 23, which states in part that “any offensive military action taken by the United States against Iran must be explicitly authorized by Congress.” The recent NIE tells us that Iran in 2003 halted its effort to design a nuclear weapon. While this does not mean that Iran is no longer a threat to the United States or its allies, it does give us time to conduct aggressive and principled personal diplomacy aimed at preventing Iran from developing nuclear weapons.”
His current actions in Libya go directly AGAINST his stated position on the subject back in 2007.
Despite the debate over whether or not “military action” is war, declared or undeclared, that is nothing more than semantics. When you bomb a sovereign nation, you are waging war, whether you declare it or not. Calling it military intervention, military action, humanitarian aid, or whatever other euphemism the government comes up with, is really nothing more than public relations, glossing over the facts to make it more palatable to the populace. Not only that, but the play on words is an attempt to get around the constitutional restrictions on waging war. If you call it something other than war, it makes it easier to argue that you didn’t exceed your constitutional authority.
