Here’s The Latest Update on The John Durham – Michael Sussmann Verdict:

After deliberating for less than one day, the jury in the Michael Sussmann criminal case returned a not-guilty verdict today in a D.C. federal court.

Notwithstanding the verdict, in prosecuting Michael Sussmann for lying to former FBI General Counsel James Baker when he provided Baker data and whitepapers purporting to show a secret communication channel between the Russia-based Alfa Bank and Trump, the special counsel revealed several significant realities to the American public.

As I detailed earlier today, United States v. Sussmann exposed that Hillary Clinton holds full responsibility for the Russia collusion hoax, with her former campaign manager Robby Mook testifying she personally approved peddling the Alfa Bank tale to the media. The Sussmann prosecution also dispatched the lingering claims that a secret communication channel between Trump and Russia truly existed as “5150,” or delusional, talk.

Even the acquittal of Sussmann will not erase these facts. So for all posterity, Clinton’s fingerprints will be seen covering the worst political scandal of our country’s history.

Clinton, however, will not be the only one whose legacy will forever be tainted. The special counsel’s prosecution of Sussmann likewise decimates the reputation of the legacy media.

The Legacy Media Was and Is a Leftist Lapdog

The corporate press has long demonstrated anti-conservative bias, but once it became clear Donald Trump would be the Republican challenger to Clinton in her bid for the presidency, the legacy media abandoned all semblance of journalistic integrity. The special counsel’s prosecution of Sussmann, however, shined a spotlight on the self-immolation of the profession in two new ways.

First, the prosecution of Sussmann made public email communications between the Clinton-campaign-funded Fusion GPS and prominent reporters at The New York Times, Washington Post, Reuters, Yahoo! News, ABC News, and Slate. Those emails exposed the supposed journalists collaborating closely with the opposition researchers working at Fusion GPS for the Clinton campaign during the 2016 election.

In one email, Fusion GPS’s co-founder Peter Fritsch pushed ABC News’s Matthew Mosk to run the Alfa Bank story, telling him, “Dude this is huge.” Fritsch took a more aggressive stance with Reuter’s Mark Hosenball, venting in a mid-October 2016 email, “Do the fucking alfa bank secret comms story,” telling him, “it is hugely important.”

When Hosenball pushed back that he lacked the technical expertise to evaluate the data, Fritsch told Hosenball to “call David Dagon at Georgia Tech.” Of course, thanks to the Sussmann trial, it is now public knowledge that, far from being a disinterested expert, Dagon worked with Joffe to craft the Alfa Bank tale sold to the media and the FBI. Dagon was also rabidly anti-Trump.

However, “neither Reuters nor ABC did the story then—but Fusion GPS soon found someone who would” when Fusion GPS’s team “went to see Franklin Foer, then working for Slate, at his home outside Washington, D.C., to brief him about the data suggesting ties between the Alfa Bank and Trump servers.”

Foer would later “break” the Alfa Bank story on October 31, 2016, sending Fusion GPS running back into the arms of the media pals who had previously rejected them. To Hosenball, Fusion GPS wrote, “big story on the trump Alfa server moving early pm,” followed by an “off the record” assurance the “U.S. government absolutely investigating.” Fusion GPS repeated the push with Michael Isikoff at Yahoo! News.

Using Federal Agencies to Push Smear Campaigns

Fusion GPS’s assurance to reporters the “U.S. government absolutely investigating” confirms the prosecution’s theory in the Sussmann case that the then-Clinton campaign attorney took the Alfa Bank data to the FBI to bolster its credibility. This also counters Sussmann’s claim that the Clinton campaign did not want the FBI involved because it could delay or kill the story. The jury, however, never learned of these emails or Fusion GPS’s use of the FBI’s investigation—prompted by Sussmann—to sell the Alfa Bank story to the press.

The emails uncovered as part of the Sussmann’s prosecution extended beyond coordination between the Clinton-funded Fusion GPS and the media concerning Alfa Bank. For instance, in mid-May 2016, even before Fusion GPS hired former MI6 spy Christopher Steele, Fusion GPS’s Jake Berkowitz emailed Foer several links with introductory sentences about Carter Page, who would later star in the Steele dossier. Peter Fritsch, the co-founder of Fusion GPS, also joined in the email thread, which continued for several days with updated research on Page.

The team effort between Fusion GPS and Foer continued, with Berkowitz on May 19, 2016, telling his Fusion GPS boss and the “reporter” that “some Merrill bond issuances during Page’s tenure” at the investment banking firm of Merrill Lynch involved some “interesting characters,” including Alfa Bank and its founders. Foer’s response to that email read as if he were a fellow Fusion GPS employee, noting he was “going to do some work on Rick Burt,” whom he bets “does some work for the Russians.” Foer then claimed in a follow-up email that Burt was on the Alfa Bank board.

Foer later incorporated the early research he exchanged with Fusion GPS in his Slate piece, “Vladimir Putin has a Plan for Destroying the West—and It Looks a Lot Like Donald Trump,” which cast Page and the Alfa-Bank-connected Burt as Russian-compromised associates of Trump. Foer was also the “journalist” breaking the Alfa Bank “scandal” at Slate just two weeks before the presidential election.

Another email thread between Fritsch and Foer focused on Sergei Millian, whom Fritsch declared was “clearly kgb.”

Washington Post Boosting Oppo Material

In addition, emails uncovered during the Sussmann prosecution revealed that during the summer and fall of 2016, Fusion GPS folks also regularly chatted with the Washington Post’s Democrat scribe, Tom Hamburger. Millian was also the subject of a July 24, 2016 email in which Fusion GPS’s other founder, Glenn Simpson, provided Hamburger three email addresses for Millian—an apparent push for the journalist to focus on Millian as part of the Russia collusion theme.

Fusion GPS’s Fritsch also pushed Millian on The New York Times’s Eric Lichtblau, telling Lichtblau in a September 27, 2016, email that Millian’s “Russianamericanchamber.com was using an IP address registered in Moscow and Alfa was its internet service provider.” That email included several screen grabs for the Times reporter showing the supposed connection between Millian and Russia. And, of course, Millian was later framed as a sub-source in the Steele dossier.

Other emails unearthed during the special counsel’s investigation of Sussmann likewise featured Lichtblau. In fact, until late last week, Sussmann intended to call Lichtblau to testify in his defense, but Sussmann dropped the Times reporter from his witness list after prosecutors made clear they intended to question Lichtblau extensively on his communications with various sources.

Lawyers for Sussmann nonetheless argued to the jury that Sussmann went to Baker with the Alfa Bank “intel” to give the FBI a heads up that the Times would soon be running a story on the secret communications network. Emails between Lichtblau and Fusion GPS seemed to negate that theory, however, while revealing the symbiotic relationship between the Clinton campaign opposition research firm and the journalist.

For instance, in an October 5, 2016, email thread between Fusion GPS’s Fritsch and Lichtblau, Fritsch provided the Times reporter the data showing the supposed Alfa Bank connection. And when Lichtblau asked the source of the data, Fritsch replied “No idea. Our tech maven says it was first posted via Reddit.”

That Lichtblau saw this data for the first time only after Sussmann met with Baker strongly suggests Sussmann’s excuse for sharing the “intel” with the FBI’s general counsel—to give the bureau a heads-up to the story—was bunk. The October 5, 2016, email exchange with Lichtblau proves fascinating for a second reason when read in light of the two versions of the Slate article that ran on October 31, 2016, when Foer broke the Alfa Bank story.

Coverage Failures Cannot Be Explained Away

The original version of the Slate article read: “In September, the scientists tried to get the public to pay attention to their data. One of them posted a link to the logs in a Reddit thread. Soon, the New York Times’ Eric Lichtblau and Steven Lee Myers began chasing the story. (They are still pursuing it.) Lichtblau met with a Washington representative of Alfa Bank on Sept. 21, and the bank denied having any connection to Trump. (Lichtblau told me that Times policy prevents him from commenting on his reporting)” (emphasis added).

Later that day, Slate updated the article, changing the “Soon” to “Around the same time,” and adding a note that “the article has been updated to make clear that the New York Times reporters learned of the logs independently, not from the Reddit thread.”

This correction indicates that the Times reporters took umbrage at the suggestion they had chased a story based on a Reddit thread and sought a clarification from Slate. But the emails uncovered during the Sussmann investigation reveal a scenario that seems even more hack-ish: The Times reporters didn’t even uncover the Reddit thread through their own investigation, but had the data handed to them by the Clinton campaign-funded opposition research firm of Fusion GPS while being told it emanated from Reddit.

While the legacy media might slough off these emails as revealing nothing but them working friendly sources, the corporate media’s failure to cover the special counsel’s prosecution of the Clinton campaign’s former attorney cannot be explained away. Rather, it provides proof that when reporters abandoned the last vestiges of journalistic integrity to crush Trump, they instead destroyed themselves. Watch for further proof of this when the corrupt media provides more coverage of the not-guilty verdict than the entire two-week trial that proceeded it.

Here’s Today’s Early Afternoon Update on The John Durham – Michael Sussmann Verdict:

Michael Sussmann has been acquitted.

The acquittal is no surprise. This is a DC jury, after all. In the Roger Stone case, for example, we documented how a juror lied to get on the panel. (That judge didn’t care.) Making matters worse, the Sussmann judge wrongly allowed for a woman to remain on the jury, despite the fact that her daughter and Sussmann’s are on the same high school crew team. One can’t help but think that juror had her own daughter’s interests in mind – the cohesion of the crew team – when she reached a decision.

On the facts, there was more than sufficient evidence to prove Sussmann’s guilt. Sussmann lied to then-FBI general counsel James Baker in order to get a meeting to pass the Alfa Bank hoax materials to the FBI. Sussmann lied again during the meeting – stating he was not there on behalf of a client – in order to get the FBI to open an investigation into the Trump Organization’s purported ties with Alfa Bank. Later, during testimony to Congress, Sussmann admitted he met with Baker on behalf of a client. Billing records proved he had been working on the Alfa Bank project on behalf of the Clinton Campaign.

I won’t say the verdict doesn’t matter. Of course it matters. It would have proven that a DC jury can convict one of their own. It would have resulted in accountability for lying to the FBI. Not the gravest of crimes, but it is still a crime.

In large part, the prosecution of Sussmann was hamstrung by the FBI’s investigation into the Alfa Bank allegations. That goes to materiality. How can the lies be material if the FBI’s investigation was so sloppy? (Answer: they were material because the lies helped open the investigation in the first place.)

On the issue of materiality, look to the testimony of FBI Special Agent Curtis Heide, whose repeated requests to interview the source of the Alfa Bank information were denied by headquarters. FBI Headquarters didn’t want this thing thoroughly vetted – even though they demanded the investigation be opened. As we stated during the trial:

Relatively early on in the investigation – on September 26, 2016 – Agent Heide sent a message to Pientka, requesting an interview of the source of the Alfa Bank white papers. By that time, Heide knew the white paper was bunk. He received no response from Pientka. He repeated this request on October 3, 2016. Agent Heide’s requests were rebuffed by his liaison at FBI headquarters:

That’s not the say the public hasn’t benefited from the trial. The information disclosed during the trial was important to understand the broader Clinton/Fusion GPS/Perkins Coie effort to poison the public, the press, and the FBI with their Trump/Russia lies. This included:

1. Data from the Executive Office of the President of the United States, including data from the Trumansition period, was exploited by Sussmann and Rodney Joffe and then passed to the CIA.

2. Rodney Joffe was a longtime Confidential Human Source (CHS) – and generally a resource – for the FBI. Joffe worked with the FBI on cyber threats from countries like Russia. From former FBI Agent Grasso: “I’m sure the work that [Joffe] did touched on matters having to do with Russia.”

3. Joffe went to great lengths to make sure the Alfa Bank information he provided to the FBI did not go through his official FBI handler.

4. The decision to open the investigation came from FBI Leadership. According to one FBI Agent, “People on the 7th floor to include Director are fired up about this server.”

5. Perkins Coie partner Marc Elias provided updates on the Fusion GPS “research” to the Clinton Campaign.

6. And - Hillary Clinton herself approved of the strategy to disseminate the Alfa Bank allegations to the media. Per Robby Mook:

   Q: Mr. Mook, before the break you had testified that there was a conversation in which you told Ms. Clinton about the proposed plan to provide the Alfa-Bank allegations to the media; is that correct?

   A: Correct. 

   Q: And what was her response?

   A: All I remember is that she agreed with the decision.

Where does Durham go from here? That’s the real question. We already know that the investigation into Rodney Joffe remains open and that Igor Danchenko faces trial this year. Whether there is more remains to be seen.

Here’s My Initial Report on The John Durham – Michael Sussmann Verdict:

The jury ruled that Michael Sussman is NOT guilty! ONLY in a CORRUPT D.C. Courtroom!

Earlier I reported that the jury in the Michael Sussmann criminal case resumed deliberations today after the long Memorial Day weekend. While prosecutors presented overwhelming evidence over the last two weeks that Sussmann lied to then-FBI General Counsel James Baker in 2016, an acquittal by the D.C. jury still seemed likely.

Judging the success of Special Counsel John Durham’s probe into the investigation of President Trump and those associated with the Trump campaign and administration should not rest on the outcome of the Sussmann prosecution, however. In fact, even if the special counsel’s office scores a conviction in its false statement case against Sussmann, that would do little to right the scales of justice unbalanced by more than five years of the politically motivated abuse of power that began as Crossfire Hurricane and continued even after Special Counsel Robert Mueller issued his final report.

So, measuring Durham’s performance by the outcome in United States v. Sussmann would be a mistake. Also, especially in the case of an acquittal, it would ignore the valuable information exposed related to the broader Spygate scandal. Using that gauge as a measure, the special counsel’s office succeeded wildly.

Durham Proved the Collusion Hoax Was a Hillary Clinton Enterprise

On September 19, 2016, Sussmann provided Baker data and whitepapers purporting to show a secret communications network between the Russia-based Alfa Bank and Donald Trump. In indicting Sussmann for allegedly lying to Baker during this meeting, the special counsel’s office revealed in its 27-page speaking indictment “a scandal much deeper than merely Sussmann’s role in a second Russian hoax — a scandal that entangles the Clinton campaign, multiple internet companies, two federally-funded university researchers, and a complicit media.”

Since then, proof that the Clinton campaign held near-total responsibility for launching the Russia-collusion hoax mounted with nearly every legal filing. It eventually culminated during the Sussmann trial when former Clinton campaign manager Robby Mook testified that Hillary Clinton personally “agreed with the decision” to feed the unverified—and quickly debunked—theory that Trump was communicating secretly with Russia through a back-door Alfa Bank channel.

Other trial evidence confirmed the Clinton campaign paid the law firm Perkins and Coie a flat fee of as much as $130,000 per month during the campaign, and authorized lead counsel Marc Elias to hire Fusion GPS for opposition research. Billing records then showed Sussmann charged his time for working the Alfa Bank hoax—including the time he spent meeting with the FBI’s General Counsel Baker—to the Clinton campaign. In fact, late last week, the jury in the Sussmann case learned that Sussmann even charged the Clinton campaign for two thumb drives purchased at Staples used for the Alfa Bank project.

While the Sussmann case focused on the Alfa Bank hoax, the detailed evidence presented over the course of that prosecution also confirmed the Clinton campaign paid for Fusion GPS to compile the Christopher Steele dossier. Given Mook’s testimony that he sought Clinton’s approval to push the Alfa Bank claims to the media, it is only reasonable to infer she likewise personally green-lighted the peddling of the claims contained in the Steele dossier.

But even if Clinton did not personally approve of peddling the lies contained in the Steele dossier, the Sussmann case established that her campaign paid for the lies—including those emanating from the Russian-national Igor Danchenko. And Special Counsel Durham’s indictment against Danchenko reveals that individuals hired by the Clinton campaign fed that Russian disinformation to U.S. media, law enforcement, and intelligence agencies.

A Court Ruling Requiring More Disclosures

Beyond exposing the Clinton campaign’s responsibility for the Russia-collusion hoax, Durham’s prosecution of Sussmann sets the stage for potentially even more damaging revelations about Clinton’s personal involvement in the scandal.

To date, the Clinton campaign has hidden behind claims of attorney-client privilege to prevent Durham from obtaining documents, communications, and testimony through the grand jury. The Clinton campaign claimed material prepared by, or communications between, Perkins and Coie attorneys, Fusion GPS employees, investigators, and other third parties are protected by attorney-client privilege. Prosecutors in the Sussmann case, however, succeeded in obtaining a court ruling that several documents withheld by Fusion GPS, based on the Clinton campaign’s claims of privilege, are not protected and must be given to prosecutors.

While Fusion GPS continues to withhold thousands of documents, this precedent provides the special counsel’s office solid grounds to challenge the privilege in both the Danchenko case and in other grand jury probes that may be pending. Piercing the privilege will prove key to further exposing Clinton’s personal involvement in Spygate.

Killing the Alfa Bank Hoax For Good

No matter the verdict the jury returns in the Sussmann case, the special counsel’s prosecution also revealed that the Alfa Bank stories were hoaxes—and the scandalous way they were crafted and seeded to America.

Voters first learned of the supposed connection between Trump and the Russian-based Alfa Bank about one week before the 2016 U.S. presidential election, when Slate reported that trusted cyber experts had discovered an “irregular pattern of server lookups” that suggested “a sustained relationship between a server registered to the Trump Organization and two servers registered to an entity called Alfa Bank.”

While the Slate article hedged somewhat by admitting “what the scientists amassed wasn’t a smoking gun,” and that the data “doesn’t absolutely preclude alternative explanations,” the headline, “Group of Computer Scientists Believes a Trump Server Was Communicating With a Russian Bank,” captured the essence of the article—and what its author Franklin Foer, Fusion GPS, and the Clinton campaign wanted Americans to believe.

The Alfa Bank hoax did not end there, however, or even after Trump’s election. Sussmann continued to push the theory to the CIA in February 2017, following Trump’s inauguration. Soon thereafter, Daniel Jones, a former staffer for the U.S. Senate Committee on Intelligence, Ranking Member Sen. Dianne Feinstein, D-California, and the president and CEO of The Democracy Integrity Project (TDIP) continued the Alfa Bank witch-hunt.

According to a complaint filed with the Senate’s Ethics Committee, staff and members of the Senate Armed Services Committee, including T. Kirk McConnell, “requested and accepted” professional services from Jones and TDIP. Specifically, the complaint alleged that the Armed Services Committee, “via senior leadership staff acting in their official capacity, asked Mr. Jones to research and offer his insights into the alleged connections between Alfa Bank and Trump Organization servers,” and to “evaluate information it had received about DNS look-ups between Alfa Bank servers and Trump Organization servers.”

Jones, the TDIP, and the Senate Armed Services Committee continued the Alfa Bank investigation long after the FBI had concluded in early February 2017 that there “were no such links” between the Trump organization and Alfa Bank. The media also persisted in pushing the supposed Russia collusion scandal.

Media Keeps the Lies Circulating

The New Yorker’s Dexter Filkins re-upped the Alfa Bank tale in 2018, in a tome titled, “Was There a Connection Between a Russian Bank and the Trump Campaign?” Filkins then resurrected the story for The New Yorker in October 2020, repeating many of the same allegations in “The Contested Afterlife of the Trump-Alfa Bank Story.”

In both pieces, Filkins referenced “Max,” who claimed that he, along with a team of other supposed guardians of the internet, had uncovered the mysterious Alfa Bank-Trump connections. But thanks to the prosecution of Sussmann, we now know “Max” is tech executive Rodney Joffe, and that his fellow cyber experts pushing the Alfa Bank hoax were April Lorenzen and David Dagon.

Court filings in the Sussmann case also revealed that the cyber researchers saw the Alfa Bank theory as flawed. They also showed another expert, Manos Antonakakis, who reviewed the Alfa Bank-Trump whitepapers, had congratulated Joffe on crafting the paper to avoid the most glaring hole in the thesis.

The more devastating take-down of the Alfa Bank theory, however, came during Sussmann’s trial, when government cyber security experts testified of their review of the data, telling the jury they had quickly concluded the hypothesis made no sense. One agent noted it sounded “5150ish” at the time. He explained to the jury he meant that the individual positing the Alfa Bank-Trump connection sounded as if he “was suffering from some mental disability.”

Exposing Deep Intelligence Corruption

Beyond burying the Alfa Bank hoax as a crazy conspiracy theory, Durham’s investigation also exposed the scandalous way the theory permeated both the media and U.S. law enforcement and intelligence agencies. Joffe tasked two Georgia Tech cyber researchers, as well as employees at tech companies over which he had influence, with mining proprietary and sensitive government data for any connection between Trump and Russia to push the Russia collusion narrative. Joffe also held responsibility for providing the Alfa Bank data to Sussmann, who shared it with the Clinton campaign’s head lawyer, Elias, and Fusion GPS, with the group then plotting to push the tale to the media.

The evidence further showed that Sussmann then fed the Alfa Bank story to the FBI, lying to Baker at the time, prompting the FBI to launch an investigation into the supposed secret communication network. Meantime, Joffe provided a different FBI contact the same Alfa Bank “intel” while asking that agent to maintain his anonymity, thereby creating a problem of circular reporting. Special Counsel Durham also revealed that Joffe still risks prosecution.

As with Sussmann, whether Joffe ever faces charges or a conviction says nothing of the success of the Durham investigation. To date, the special counsel has succeeded in exposing Hillary Clinton’s role in the hoax—and that the Alfa Bank hoax was real and spectacularly scandalous.
