What is the EB-5 visa program and how does it work?

The EB-5 visa program is a special immigration program that allows foreign investors to obtain a green card and become lawful permanent residents of the U.S. by investing in a new commercial enterprise in the U.S. and creating or preserving at least 10 full-time jobs for qualified U.S. workers. The EB-5 visa program also has some risks and challenges for investors, such as:

•  The possibility of fraud, delays, denials, and visa retrogression. The investor should be aware of the risks and challenges that may affect their EB-5 application and investment. The investor should do thorough research and due diligence on the project and the partners involved, and consult with professionals, such as lawyers, accountants, and financial advisors, before making their decision. The investor should also be prepared for any inquiries, requests, or notices from the USCIS, and any changes in the EB-5 visa program rules and regulations.

•  The requirement to invest at risk and to create or preserve jobs. The investor should understand that their investment must be at risk, which means that they may lose some or all of their investment. The investor should also understand that their investment must create or preserve at least 10 full-time jobs for qualified U.S. workers within two years of the approval of their petition. The investor should also understand that their investment must comply with the EB-5 visa program requirements and regulations, and that they must provide evidence and documentation to prove their compliance.

•  The difficulty to exit the investment. The investor should understand that their investment is not liquid and that they may not be able to exit their investment easily or quickly.
