The Final Loss of Freedom in America – The NDAA

Obama’s promise that he would not use the NDAA to jail Americans permanently without charge is proven to be a lie in his court battle to keep the law on the books.

Last year Congress passed the National Defense Authorization which declared an endless global war with no borders or no clearly defined enemies, essentially the declaration of World War 3.

When it was announced the bill declared the United States as part of the worldwide battlefield in the war and that it authorized jailing Americans permanently without evidence, trial, or charge activists and civil rights groups raised hell and planned widespread protests across the country.

Obama told the public not to worry about the legislation.

He calmed their fears and prevented the protests by promising to veto the bill once it arrived on his desk.

On December 31st, 2011 Americans were shocked when he broke his promise and signed the the legislation into law.

Instead, he pulled a PR Stunt and issued a signing statement promising he would not use the legislation against American citizens.

“My administration will not authorize the indefinite military detention without trial of American citizens,” Obama said in the signing statement. “Indeed, I believe that doing so would break with our most important traditions and values as a nation.”

Many were convinced but others saw it as just another empty promise and said those who were crying Obama would use it were just fear mongering since he promised he wouldn’t.

A coalition of journalist and activists filed a lawsuit against Obama to have the legislation ruled as being unconstitutional and prevent the government from using it against American Citizens claiming they were being silenced with the bill and threat of being detained indefinitely.

The president who pulled a PR stunt to claim his signing statement made the Law null and void for some odd reason decided to fight lawsuit and used the government’s lawyers to keep legislation in effect.

In court, the Obama refused to assert to the Judge the NDAA wouldn’t be used to subject the journalist to indefinite detention – who are American citizens – for simply exercising their Freedom of Press rights.

If the statements he made in his signing statement were true, he could have simply asserted it and court and the lawsuit would have been dismissed.

Instead he refused to promise the NDAA wouldn’t be used against the journalist and forced Federal District Court Judge Katherine Forrest to rule that not only was the bill unconstitutional but his signing statement did nothing to prevent him or any future President from using the legislation.

In the ruling the courts issued a temporary injunction preventing the government from subjecting U.S. citizens to indefinite detention pending a permanent ruling.

The President, who had promised to veto the bill and promised he did not plan on using the NDAA against U.S. citizens, then fought the court’s decision asking the courts to immediately remove the injunction claiming it severely limited the government’s ability to fight the War on Terror.

Obama is now openly defying the Federal Ban on indefinite detention of U.S. citizens.

For those who believed the NDAA wouldn’t be applied to U.S. citizens or that believed Obama would never use it against U.S. citizens even if it did allow it your eyes should now be wide opened.

Now that it is clear the NDAA does apply to you, me and every other American citizen.

It is clear that Obama will use it on U.S. citizens despite his public speeches, otherwise he wouldn’t be fighting so hard in court to keep the legislation in the books.

Obama refused to define to the courts what falls under the realm of “directly or substantially supporting terrorism”.

Even worse is Obama refused to assert to the courts that the journalists wouldn’t be classified as “directly or substantially supporting terrorism” for just engaging in Freedom of Press activities.
