“ASYLUM” is the new ‘Catch 22′ legal loophole being used by the previous and future [Caravans] of those from Central America seeking, NOT a “better life in America,” but are fleeing [Persecution].

However….it’s obvious, ‘asylum’ is the farthest claim on their minds, but instead it is what benefits the Dems propose for them and what Americans have carelessly provided for years.

The clash at the border will be in front and from behind law enforcement agents and military.

That’s all about to change…FAST!

President Trump’s lawyers are scrambling to decipher ‘asylum’ and the actual rules and laws thereof, while Democrats are now suing the Trump Administration on behalf of the ‘Caravan.’

“The applicant has the burden of proving that he (or she) is eligible for asylum. To satisfy this burden, an applicant must show that she has a well-founded fear of persecution in her home country on account of either race, religion, nationality, political opinion, or membership in a particular social group.^[22]

The applicant can demonstrate her well-founded fear by demonstrating that she has a subjective fear (or apprehension) of future persecution in her home country that is objectively reasonable.

An applicant’s claim for asylum is stronger where she can show past persecution, in which case she will receive a presumption that she has a well-founded fear of persecution in her home country.

The government can rebut this presumption by demonstrating either that the applicant can relocate to another area within her home country in order to avoid persecution, or that conditions in the applicant’s home country have changed such that the applicant’s fear of persecution there is no longer objectively reasonable.

Technically, an asylum applicant who has suffered past persecution meets the statutory criteria to receive a grant of asylum even if the applicant does not fear future persecution.

In practice, adjudicators will typically deny asylum status in the exercise of discretion in such cases, except where the past persecution was so severe as to warrant a humanitarian grant of asylum, or where the applicant would face other serious harm if returned to his or her country of origin.

In addition, applicants who, according to the US Government, participated in the persecution of others are not eligible for asylum.^[23] “

“Well-founded fear of persecution”….REALLY??

First…a refugee fleeing “Persecution” must first prove they could NOT move to another city or another part of their country to avoid persecution involving the GOVERNMENT’S actions against the (asylum seeker) based-on their Race, Religion, Nationality, Political Opinion, or Membership in a particular group.

Second…a refugee fleeing that country and enters a second country that offers that refugee (asylum) must accept asylum and (generally) cannot refuse that asylum because the next country offers MORE!

The general argument (those within the caravans) are presenting (as an argument) is that gangs (not government) are targeting their family. I guess they do not know what life is like in Chicago or Los Angeles.

Therefore…their claims have NOTHING to do with their Race, Religion, Nationality, Political Opinion, or Membership in a particular group….and their son being a member in the MS-13 gang and then murdered does not apply here. Membership in a political group to overthrow a repressive government (Cuba) or membership in a ‘Gay Rights’ movement where a government oppresses all ‘Gays,’ or a country that mutilates genitals of women…..then the argument for asylum can be considered.

Families in Chicago cannot claim asylum in Mexico or Canada because they themselves are targets of MS-13 gangs…..the law is clear and during an immigration asylum interview would be….”since you have decided to travel many miles to avoid the dangers of Chicago, seeking asylum in [our] country, did you first try to seek-out a place in the United States, like Topeka Kansas or anywhere far from Chicago….and lastly, was the United States government (also) targeting you based-on your claim of persecution?”

“Sorry….your request for asylum is denied.”

The argument for “persecution” by those in the caravan is not warranted….PERIOD !

However….the Dems and the Deep State operatives behind the scenes are setting these people up for a major disappointment and their supporters helping them along the way and those that intend to greet them upon arrival with (teddy bears) and legal assistance are hoping for violence…..

U.S. Border Patrol and Active Duty Military troops can expect violence in front of them and behind them as Dems organize a presence at the border to protest law enforcement.

‘Migrant Caravan’ Members Sue Trump Over ‘Shockingly Unconstitutional’ Asylum Crackdown

President Trump’s rhetoric about the organized ‘caravans’ of migrants plodding toward the US border has been nothing short of incendiary, as the president has threatened to send as many as 15,000 troops to the border to stop the mobs of “dangerous people” from entering the country. Among other claims, Trump hinted that he might ask soldiers to fire on the migrants if they start pelting border agents with rocks, and that he would be building “massive cities of tents” to house the would-be asylum seekers as they await their hearings in an effort to end the “abuse” of the US asylum seekers.

Well, apparently these remarks haven’t sat well with members of the caravan and their shadowy financial backers, because a group of 12 migrants, six of them children, have filed a lawsuit against Trump, claiming his efforts to beef up security along the border, and threats to deprive them of asylum, represent “shockingly unconstitutional” attacks on their rights, according to Fox News.

“Don’t Ever Repeat This”: Beto Aides Busted Funneling Caravan Funds In Undercover Sting

James O’Keefe’s undercover operatives at Project Veritas have done it again; this time filming campaign staffers for Congressman and US Senate candidate Robert Francis “Beto” O’Rourke, seemingly engaging in the illegal use of campaign resources to help transport Honduran nationals traveling in the Central American caravan headed towards the southern US border.

O’Rourke staffers Dominic Chacon and AnaPaula Themann admit to facilitating transportation to airports and bus stations.

Featured in this report are campaign staffers who work on Congressman O’Rourke’s US Senate campaign discussing how they use campaign resources to help Honduran aliens and transport them to airports and bus stations. Said Dominic Chacon and AnaPaula Themann, who work on O’Rourke’s campaign.

A Project Veritas Action attorney reviewed the footage and assessed:

“The material Project Veritas Action Fund captured shows campaign workers covering up the true nature of spending of campaign funds and intentionally misreporting them. This violates the FEC’s rules against personal use and misreporting. It also violates Section 1001, making a false statement to the federal government. The FEC violations impose civil penalties, including fines of up to $10,000 or 200 percent of the funds involved. Violations of Section 1001 are criminal and include imprisonment of up to five years.”

Chacon and Themann also explain how they go about concealing their use of campaign funds for alien support purposes:

Themann: “There’s actually stores that just mark it as ‘food’ they don’t mark different types… at Albertsons, on the receipts, it marks it just based off of brand…”

Chacon: “I think we can use that with those [campaign pre-paid] cards to buy some food, all that s**t can be totally masked like, oh we just wanted a healthy breakfast!”

Themann says that she doesn’t “want to make it seem like all of us are from [the O’Rourke campaign]” when going to distribute supplies to the Honduran aliens. She adds, “I just hope nobody that’s the wrong person finds out about this.”

Chacon elaborates on the usage of pre-paid campaign cards, saying, “We’re going to use more of those cards to get them more supplies too. So it’s all going to work out. I’m done being nice. I’m done being professional. [Be]cause nothing is professional. None of this is like s**t there is a rule book for, you know?”

Later in the report, Chacon also reveals “there’s not really an approval process” regarding the usage of the pre-paid cards, and that “we can just go and get the food and we can come up with a BS excuse like as to why we needed to get this stuff.” He adds, “Under the table just sort of do it.”

“Nobody needs to know”

Chacon explains that Jody Casey, the campaign manager for the O’Rourke campaign, was happy to hear about their efforts supporting aliens with campaign funds:

Chacon: “She texted us afterward and was like, I’m so happy that we have a staff that gets it and was there, I was so happy to see y’all there, still working, still contributing, we have the best team ever… she was good about it.”

Journalist: “So, Jody knows?”

Chacon: “Well, she doesn’t know we used the pre-paid card, but she doesn’t need to know.”

Added Chacon, when discussing the possibility for using campaign vans to help the Honduran aliens, “we could probably get away with using the vans… Nobody needs to know.” Chacon also says, “For me, I can just ignore the rules and I’m like f**k it.”

When asked about using campaign resources to help the Honduran aliens, Casey said “don’t worry”:

Journalist: “It just made me really concerned, like, you know, because I know that we’re using some of the campaign resources to help with the migrants and like, I just didn’t want anybody to get in trouble with that…”

Journalist: “Like I didn’t want them to ask me any questions about people using resources…”

Jody Casey: “Don’t worry.”

Andrea Reyes, who also works on the O’Rourke campaign, revealed that she has text messages showing she received approval for using the pre-paid cards:

Reyes: “The thing is yeah, as long as we’re not advertising it. I mean yeah, I don’t really know. They said it was fine sooo *throws hands up* I mean I don’t know, okay. I told you about it! I have the text messages to prove it, sooo…”

Journalist: “So you told Jody?”

Reyes: “Yeah. I told Jody and I told my director.”

When asked about using campaign vans to assist the Honduran aliens, Chacon reveals that they are going to transport the aliens to airports and bus stations:

Chacon: “… we’re going to give rides to some of the immigrants too. Like to the airport, to the bus station, like why not, you know?”
