Anyway, I went ahead and typed the new 2241 to you. I also put a copy of the entire brief and that included the exhibits in the U.S. Mail to Rudy D. (edited). I did this as Rudy has told me that he would scan it into his computer and share it with everybody.
This way I will have gotten it to everybody fast, without having to make any more copies, as I lost all my copy cards. So right now it is already in the mail to the Court and should be there about Thursday of this coming week.
Everybody that has now read this brief now thinks that it could actually win. We have to answer their response in the next 25 days, so we need to be ready or have someone ready to make the final answer. If this brief actually wins, I would be released.
Note that we still might have to get past the procedural bar. We might be there already according to B because of these new rulings (see 2241). But, if you ever wanted to have some new eyes on the case, now would be the time to do this, as any body including you could now jump in and file an amended brief or even add some new things to the answer that we must file within the next two weeks; it is now or never.
Also, I could not get the $5.00 filing fee sent with the brief, as that would take up to two more weeks to get it in the package, so I mailed the brief to the Court without the filing fee enclosed. Therefore, please, send the $5.00 filing fee via priority mail to the Clerk of Court, 310 Main Street, 1st Floor, London KY 40741.
Put on the Certified Check or postal money order “For David Hinkson’s 2241″; as they have not assigned it a case number yet.
We are still now waiting for the Demaya case to be ruled on. Maybe with Murphy’s law it will happen this coming week.
This could happen any minute. I’m tired of the whole situation here, as B wants endless amounts of money. But he does do good work when he wants and is motivated, but I was left to try to keep him paid with my limited resources.
But the whole situation is very very tiring. So, I can find a new paralegal to help at the new unit, or we can continue to try to work with Bob, but it is getting very stained on this end; maybe you have a paralegal out there somewhere that might put eyes on this brief.
I don’t mind paying what ever B wants if I can now just win and finally get out. He takes advantage of my desperation, as I have no one on the street to help me at this time and they sense my weakness. I’m really on my own and struggling to not die here in prison.
So, now we should pray and maybe help Rudy to push politically to get the court to just rule one time in a correct manner and grant this 2241. Now would be the time to call some elected officials. At least we are no longer in the 9th Circuit.
