Student Loses "Mark Of The Beast Case," Must Wear Badge To Continue At School

San Antonio student Andrea Hernandez who refused to wear a John Jay High School RFID badge issued by the Northside Indenpendent School District that tracked her movements has lost a federal court appeal against her school’s ID policy.

The radio chips track attendance, which in turn helps secure school funding. Hernandez called the badge the “mark of the beast”, as described in chapter 13 of the Book of Revelation in the Bible

The 15 year old Hernandez stopped wearing the badge on religious grounds, saying it was the “mark of the beast”.

After John Jay High School suspended her, she went to court and won a temporary injunction to continue her studies at the school, without the tag.

A federal court ruling overturned that, saying if she was to stay at the school, she would be required to wear the badge. Otherwise, she would have to transfer to a new school. U.S. District Judge Orlando Garcia said in his decision that the accommodation offered by the district to remove the RFID chip from her badge “is not only reasonable it removes the plaintiff’s religious objection from the legal scurtiny all together.” 

Plaintiff has been wearing a student ID badge for several years. She doesn’t object to wearing her old ID badge, yet she objects to the new ID badge issued by Jay H.S. despite the fact that the chip has been removed. Plaintiff’s objection to wearing the Smart ID badge without a chip is clearly a secular choice, rather than a religious concern. A.H. and her father have publicly voiced their objection to the entire pilot program, and her father believes that wearing the student ID badge without a chip would give the appearance of acquiescence. Mr. Hernandez testified that A.H.’s acceptance of the accommodation would “put a smiley face” on the pilot program. It would “make a statement that [A.H.J fell in line to support the program” and he would “look like a fool.” The First Amendment does not protect such concerns. Northside ISD began using the power of radio frequency identification technology (RFID) to make schools safer, know where our students are while at school, increase revenues, and provide a general purpose “smart” ID card at the beginning of the 2012 school year. 

The Student Locator Project is currently being piloted at two schools. They are Jay High School and Jones Middle School, two of 112 schools in Northside ISD. The pilot will last one year after which time the data will be evaluated and decisions made about further implementation in future years.  

Jay and Jones have a combined enrollment of 4,200 students (out of a projected 100,000 students in NISD). The pilot is small relative to the size of the school district. The “smart” ID cards only work within the school.

THREE GOALS

  1. Increase student safety and security. Our students’ parents expect that we always know where their children are in our schools.
  2. Increase attendance. Through more efficient attendance management, schools can generate additional revenues by identifying students who are not in their seats during roll call but who are in the school and locate them. (Increased attendance = increased state revenues)
  3. Provide multi-purpose “Smart” Student ID card. The Student ID will provide access to the library and cafeteria, serve as a photo ID, and allow for the purchase of tickets to schools’ extracurricular activities. Other uses will be rolled out during the pilot program.

Radio frequency identification (RFID) is a generic term that is used to describe a system that transmits a unique serial number wirelessly, using radio waves. It’s grouped under the broad category of automatic identification technologies.

Auto-ID technologies include bar codes, optical character readers and some biometric technologies. The auto-ID technologies have been used to reduce the amount of time and labor needed to input data manually and to improve data accuracy. Some auto-ID technologies, such as bar code systems, often require a person to manually scan a label to capture the data. RFID is designed to enable readers to capture data on and transmit it to a computer system—without needing a person to be involved.

To retrieve the data stored on the “smart” student identification card, readers are installed throughout the school*. A typical reader is a device that receives signals back from the “smart” card. The reader then passes the information in digital form to a computer system.

RFID technology has been used by thousands of companies for a decade or more.

*”Smart” ID Cards will only work inside the school.

        She’ll probably learn more at home. The schools today are a propaganda machine, students come out of it with more burnt brain cells, LOL.

        If it were as simple as home schooling that would solve the problem but, its NOT THAT SIMPLE! The educational system is built upon establishing in your children the secular liberal humanist mindset. Makes no difference if they’re taught in the public schools or home schooled.

        If it were as simple as home schooling then the problem might be solved, but its NOT that simple. The education “establishment” teaches the secular liberal humanist tradition to the students who’re basically forced to attend public school, by law. Even if home schooled the “establishment” requires students to learn what they require them to learn, by law. Now they’re requiring students to wear or carry an RFID, by law. Home schooling can now be done “online” and you can bet that students will be required to have an RFID on them in order to “log on”, by law. Soon it may become mandatory for ALL to have an RFID on them in order to access the Internet, enforced by law. Anyone NOT conforming to the laws of the “establishment” will no longer be considered a “law abiding citizen”.

      She and any other person will lose such cases in a court of law because religion has no legal standing other than your right to practice it in a private life capacity. That does not include objecting to secular school policy or where you work or anywhere not to do with your particular religion. You might just as well claim it’s against your belief in the tooth fairy. The belief is based on denial of reality, not faith on a lack of evidence, seeing as there is plenty of evidence that proves Christianity is plagiarised from older pagan traditions. Courts go where the evidence is, not on peoples plagiarised fantasies. :wink:
