Man Arrested For Legally Carrying A Concealed Gun
A video shows Joel Smith of Citrus County getting stopped by Deputy Alan Cox.
17 seconds after getting out of the car, he is asked for his registration and insurance, reports ADGUKNEWS
As he turns, something is slightly visible in his back pocket.
“Why do you carry a gun for?” asked Deputy Cox.
Ten seconds later, he is being held at gun point.
“Put your hands right up or I’ll shoot you in the blanking back,” said Cox.
Smith is legally licensed to carry a concealed weapon.
“Get down on the blanking ground now,” screamed Cox.
Smith was arrested anyway charged with carrying a prohibited weapon openly.
The Unified Sportsmen of Florida call it an overreaction.
“A law enforcement officer losing it and abusing a law abiding citizen who had done nothing wrong and was doing anything he could to cooperate,” said Marion Hammer.
When the case got to the courthouse, the state attorney declined to prosecute saying there was little chance a jury would convict.
Florida law was changed in 2011 to say the brief viewing of a gun in a non-threatening manner is not a crime. Unified Sportsmen say Smith’s case and another are proof Florida needs to do more.
“They’re arguing that the accidental exposure was not brief,” said Hammer.
Deputy Alan Cox has now been put on administrative leave pending an internal investigation.
The investigation was ordered after the video went viral. The charges against Smith were dropped 17 days after the arrest. Smith’s attorney for the arrest called Smith’s cell phone and found the number had been changed. A listed land line is also no longer in service.

I don’t care what the UN says they are not the law of the land and I refuse to be violated by any person that doesn’t follow the law.In my state everyone is armed and concealed and if a fed tries to disarm you then they will be but in jail and fined.When you have people like this guy out there he is a danger not only to himself but to others that know the laws.My self I would of shot him but thats just me.
oddly enough; if a cop threatens to shoot you and then attempts to act upon that threat for no reason…you can legally shoot them. it’s this weird thing called self-defense
I am a CWP holder in Florida and there’s no doubt that the officer overreacted. The man was not being belligerent or resisting in any way. The officer should be reprimanded and the man should sue the officer and the department.
How many laws did he break? Let’s see. False arrest. Illegal search. I could go on but to me that is all it takes. And he is what we call a police officer? Well if I were on the jury in a damage suit for the victim in this case I would throw the book at the arresting officer! That is why they (police officers) are referred to as PIGS.
I hope that cop is looking for another job, and never finds one. We need to create an island for people with control issues like this cop and move them all there were they can’t harass law abiding citizens.
I’m just asking because I don’t know FL Law. I do live in Arizona and do have a CCW permit and have been through the classes, though recent law changes make having a CCW permit no longer required to carry concealed, though I personally think still getting the CCW permit is a good idea.
Is the driver of the car required to inform the officer he is carrying? Would this problem have been avoided had he simple done this?

SUE THIS POS COP! sue him in his personal capacity under the 11th amendment stripping doctrine and sue him until he is JOBLESS AND HOMELESS!!! Attach his public hazard bond and seize it! if he gets another bond, seize that! after that, no bonding agent will touch him! result, never able to hold a government job for the remainder of his unnatural life!!!
