I was sitting in court today thinking we are going to win this thing! That is how exciting it was to witness. We witnessed so much inaccurate and conflicting stories on behalf of the prosecution it caused the judge to even question how and what real evidence exists, if any, that shows that a “conspiracy to impede” charge is even accurate. To see so much in question knowing that so many are going on 8 months behind bars and away from their family, for what, was quite frustrating but exciting nonetheless. This post will have several parts so if you don’t see all of it at first, just keep refreshing.

On a side note, Ryan Bundy was in a blue jumpsuit today instead of white. Angie does that mean he was taken out of solitary segregation?!?! I forgot to ask him! I hope so. (ed: He was.)

Started out the morning with sworn testimony from Michele Holman Kerin and Doug Paul Angel both of whom have been employed by the US Attorney’s office for several years. David Fry’s attorney Mr Olson revealed that the FBI and the Prosecution did not follow orders regarding a warrant to access the defendants Facebook accounts, jailhouse phone calls, and jailhouse kites and improperly shared raw data. Data that was suppose to be sealed but somehow ended up in the hands and reviewed by several unauthorized parties. Interesting observation about these two testimonies was that they both had a lot of information and remembered precise details about what happened with information that wasn’t important but when cross examined neither could recall anything with regards to the information that mattered. And neither could recall who was responsible. Even more absurd than that was that even though they couldn’t recall the important information and/or who was responsible, the prosecution argued that they FOR SURE knew that the mistake happened in the US Attorney’s office and was not the mistake of the FBI. Judge Brown asked how he could be so sure and he wasn’t able to respond with anything substantial enough to support the comment. After a quick 15min break he even happened to find an FBI agent to testify. Agent Ronnie Walker, but each testimony didn’t add up and was full of gaps. Judge Brown was left even more confused. She ordered prosecutors to provide an accurate, chronological accounting of who did what with privileged, raw Facebook account data. And a list of everyone who had their hands on this raw data.

“I want those holes filled,” Brown said. “This has to be accurate.”

Last month, judge Brown denied Olson’s motion to suppress the voluminous Facebook data obtained by the government in the case. September 6th defense will have another opportunity to suppress the Facebook data.

"How can the federal judiciary be independent and impartial when
the law permits the federal government to secretly award judges up
to $25,000 in undisclosed secret "cash awards," and to privately,
secretly and "erroneously" overpay them up to $10,000, and "waive"
these erroneous overpayments?

How can any defendant be found innocent or "guilty beyond a
reasonable doubt" when such statutory "cash award" provisions on
their face create an irrefutable, behind-the-scenes incentive for
the prosecution? These questions and others must be answered by the
U.S. District Court in Portland, Oregon following a lawsuit naming
multiple defendants in the Department of Justice including Judge
Anna J. Brown, who presided over a trial of "conspiracy to impede
the IRS" last November.
