WARNING TO MEDICAL MARIJUANA USERS: on August 11th the DEA and the Executive Branches Department of Justice publicly declared marijuana to be a schedule one narcotic like heroin and cocaine. This classification of course is nothing new but with all the individual states legalizing pot for both medical and recreational use the timing of this harsh posturing would seem suspiciously odd. Because of where we are and the very real possibility that martial law could be on the near horizon I suspect that there is something far more sinister behind what is a seemingly simple proclamation.
Let’s try to remember that it was not necessary for the DEA to make this announcement. Nothing has changed. This has been the federal government’s policy for as long as I can remember. What this proclamation does accomplish is to establish a threshold for exercising enforcement of such policy. What is happening is that the citizens in the states that have compassionate medical marijuana laws or have legalized recreational consumption are being put on notice that they are subject to felony charges. Those listed in required statewide databases, who might likely be in possession of controlled substance or perhaps cultivating their own weed in a backyard garden can be raided, picked off one after another. It provides the feds reasonable suspicion to obtain search warrants, or access without a warrant to homes who can be visually observed cultivating pot.
In the federal governments distorted view they have full jurisdiction and through fines, court fees, forced prison labor and forfeiture they stand to profit at the expense of the American people. The truth is however that the United States Constitution’s Ninth Amendment in essence states that the enumeration in the Constitution of particular rights cannot be construed to deny or disparage other inalienable rights and privilege retained by the people. Corresponding with that notion the US Constitution’s Tenth Amendment states that any and all powers not specifically delegated to the federal government by the US Constitution, nor prohibited by it are retained by the individual states respectively, or by the people.
What this means in legal terms is quite simple. If there is no interstate commerce involved, then according to the Constitution no power then exists for the federal government to override the legislative authority of individual states, or the will of the voters in regard to marijuana’s use or consumption. The federal government has assumed authority where none legally exists, but they intend to use this to gain access to homes, squash dissent and confiscate property. Be forewarned, there is just no other logical reason for the DEA’s recent announcement.
Could this have been their plan all along. You betcha! By allowing or facilitating states to adopt laws that conflict with federal law the barn door has been left wide open for future abuse! Be smart folks, don’t step in their snare.
