I would not be surprised if Sessions backs out and at the same time, a Grand Jury is appointed. That would make perfect sense. Everybody wants to get to the bottom of this now and Obama and Lynch cannot obstruct justice any longer. The fact that Trump just played dumb in his interview with ABC today confirms that he will just stand back and watch! Even Comey said he welcomes an investigation. You know he has talked to Trump about all this! Trump and Comey will both get their revenge here! Perhaps we will really find out what the deal is with Comey.

You cant pardon someone who hasn’t been convicted of a crime. You cant convict someone of a crime without bringing charges against them.

Totally different scenario. Nixon had already had impeachment charges brought against him by the House Judiciary on February 6, 1974. He was headed for removal from office via impeachment. He was pardoned by Ford on September 8, shortly after resigning. His battleship was sunk, the proof was in the public and every legal challenge going all the way to the Supreme Court had been rebuffed.

Nixon didn’t have charges. The impeachment process is not a criminal case. Being charged by the House and convicted by the Senate would remove a President from office. Nothing more.
Actual criminal charges would come after that removal.
And the legal issues pertaining to those charges would come then, also.
It is EXACTLY the same situation as a Clinton pardon would have been. A pardon to pre-empt criminal charges.

Nixon was not convicted of any crime and the pardon made it impossible for him to be prosecuted for any crimes he may have committed.

Charges in Congress, for the purpose of removal from office, are not criminal charges.
That’s why Murphy went to court to try to overturn the pardon. In Murphy v. Ford. Murphy didn’t believe Ford should be able to pardon Nixon in advance of any charges.
And the federal district court upheld Ford’s right to do that. Citing Ex parte Garland.

What needs to be understood, as exactly with the Nixon case, is that you do not even have to be formally “charged” to be pardoned.

Pardons are pre-emptive in both scenarios. Just as Nixon could not be prosecuted for ANY crimes, (even those not yet charged with), the same would have applied to hillary.

Ex parte Garland is the most important. It said “… the President’s pardoning power is ‘unlimited,’ and ‘It extends to every offense known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment.’”
Note it says “…before legal proceedings are taken…”
The other precedent is Burdick v. United States, which concerns a Presidential pardon granted in advance of any charges, to a newspaper editor, so he could be compelled to testify before a grand jury.
The Court ruled that Burdick didn’t have to testify, because (1) he didn’t accept the pardon and (2) refusing to testify doesn’t necessarily mean guilt. One might fear being unjustly prosecuted.
A federal district court ruled in Murphy v. Ford that President Ford did have the power to grant Nixon his pardon, even though Nixon wasn’t charged.
And AS I explained below, charges made by Congress, as reasons for removal from office, are not the same as criminal charges. The only penalty is removal from office.

Candidate and then President elect Donald Trump said “he” wouldn’t pursue legal actions in regard to Hillary Clinton and all of her “alleged” criminal misconduct. Notice he conveniently left out the DOJ under new leadership. But seriously, the scandals involving Hillary Clinton must be investigated as a matter of national security. Should the twice failed democrat presidential candidate (I like saying that) Hillary Clinton be found guilty of the alleged crimes and scandals that have hovered around her for years, there would have to be other players involved. We must get to the bottom of the Clinton mess not to just levy charges against the twice failed presidential democrat candidate Hillary Clinton, but to find out who else was involved, and more importantly if any of those involved are still within the government. There is also the very real issue of the American people no longer having any faith in the US justice system. In order for the American people to regain any respect and trust in that system, the system must prove that it has overcome its past problems and prove it to all US citizens. There could be no better way to accomplish that than to fairly, without bias investigate any suspected crimes by anyone, regardless of how powerful they may be. I suspect that further investigations, no longer hampered by bias, blackmail or anything else, will, without doubt find Hillary Clinton guilty of most of the crimes she has been suspected of committing. The truth will be laid out then for everyone to see. Hillary Clinton and those complicit in her criminal activities will face the same justice as anyone else. For the right wing Conservatives it will be the key to restoring their trust. For the left wing democrat voters, they will finally have their eyes opened as to how criminal the democrat party is. Many will leave the party and never return. For the democrat party leaders, well I suspect that many of them will be in the same boat as Hillary Clinton. It will be the final nail in the democrat party in this country. Bottom line is that the liberal democrat party must be exposed as the criminal enterprise that it is. It must be abolished during President Trump’s first term. We came too close to losing our country and our freedom. The way to do this is to expose and put up for display every criminal act they have committed.
