EU Upgrades CLP Regulation for Substances and Mixtures

The EU has recently amended the CLP Regulation by expanding the list of substances and including new classification and labeling requirements for existing substances. The new law will be enforced starting 1 January, 2017.

Classification, Labeling and Packaging of Substances and Mixtures

On 25 July, 2015, the European Union (EU) published Regulation (EU) 2015/1221 (1) amending Annex VI to Regulation (EC) 1272/2008 on the Classification, Labeling and Packaging of Substances and Mixtures (CLP Regulation) regarding the harmonization of a number of existing and new substances (2).

This amendment is the 7th adaptation to technical and scientific progress (ATP 7) for the CLP Regulation. It amends 12 existing entries and adds 20 new entries to Table 3.1 under Part 3 of ANNEX VI of the CLP Regulation. These new amendments and entries are also updated in the corresponding entries under Table 3.2. In Table 3.1, the classification and labeling are based on the criteria in Annex I to the CLP Regulation. In Table 3.2, the classification and labeling are based on the criteria in Annex VI to Directive 67/548/EEC (Dangerous Substances Directive, DSD).

Changes in CLP Regulation

There are a number of significant changes in ATP 7. The interesting changes in Tables 3.1 and 3.2 under Part 3 of ANNEX VI of the CLP Regulation are:

- Tributyltin compounds (1); an existing substance with new classification and labeling codes.
- 1,2-Benzenedicarboxylic acid, dihexyl ester, branched and linear (2); a new phthalate.

The enforcement date of the new regulation will be 1 January, 2017.
