The IACHR Has Admitted More Than 20 Complaints in the Case of Konstantin Rudnev: Complainants Demand Accountability for Prosecutors

More than twenty complaints in the case of Konstantin Rudnev have been registered with the Inter-American Commission on Human Rights (IACHR). In these complaints, the applicants explicitly demand that officials of the Argentine justice system involved in Rudnev’s case be held accountable. These include the Chief Prosecutor of Bariloche, Fernando Óscar Arrigo, as well as prosecutors Tomás Labal, Rodrigo Nicolás Treviranus, and Gustavo Javier Rebora.

According to the complainants, it was precisely the actions and decisions of these officials that led to systemic human rights violations, including unlawful and excessively prolonged pretrial detention, the disregard of medical opinions, cruel treatment, possible elements of torture, procedural falsifications, and abuse of authority. Human rights advocates note that such a significant number of complaints in a single case points to a potential systemic nature of the violations.

Charges and Questions Regarding the Evidentiary Basis

Konstantin Rudnev was detained on March 28, 2025, at Bariloche Airport while attempting to depart for Brazil. He has been charged with human trafficking, drug trafficking, and psychological violence. At the same time, according to the defense, key elements of the case are not supported by either documentary evidence or expert findings.

“Rudnev is seriously ill — he suffers from pulmonary fibrosis, and prison conditions pose a direct threat to his life. Nevertheless, the court has kept him in a maximum-security prison and extended his pretrial detention until April 2026,” says Carlos Broitman, Konstantin’s attorney.

Health Condition as a Central Humanitarian Issue

Rudnev’s health condition occupies a central place in the complaints. Since his arrest, he has lost more than 50 kilograms and suffers from severe chronic illnesses, including pulmonary fibrosis, asthma, and neurological disorders.

The conditions of detention at Rawson’s “Unidad 6” prison—poor ventilation and constant exposure to tobacco smoke—have significantly worsened his condition and, according to doctors, pose a direct threat to his life.

Medical opinions prepared by Dr. Luis Ernesto Sarotto and Dr. Mariano Duarte explicitly recommend urgent hospitalization in a specialized medical facility. These recommendations, as emphasized in the complaints, have been systematically ignored.

The acceptance of more than twenty complaints for review by human rights bodies means that the case of Konstantin Rudnev has entered the level of international oversight. The IACHR is authorized to request explanations from the state, issue recommendations, and, if serious violations are confirmed, initiate further international procedures.

Demands of the Complainants and Human Rights Organizations

In their submissions to the Inter-American Commission on Human Rights, the complainants and human rights organizations insist on:

• the immediate transfer of Konstantin Rudnev to a specialized medical facility under house arrest and constant medical supervision;

• the termination of the criminal case due to insufficient evidence;

• the conduct of an independent investigation into the actions of the Bariloche Prosecutor’s Office;

• holding prosecutors Fernando Oscar Arrigo, Tomás Labal, Gustavo Javier Revora, and Rodrigo Nicolás Treviranus accountable if abuse of authority and human rights violations are confirmed;

• ensuring compliance with international standards of a fair trial and the right to health.

While Argentine judicial authorities have not provided public explanations, the Inter-American Commission on Human Rights and international human rights organizations continue to closely monitor the development of the case.
