A Kentucky Revolution?

The Kim Davis incident in Kentucky has become increasingly more provocative. Davis is an elected county clerk in Rowan County, KY who was incarcerated for refusing to violate the constitution of Kentucky and issue marriage licenses to homosexuals because of a recent, wildly unconstitutional US Supreme Court opinion. U.S. District Judge David Bunning ordered Davis to jail because she was “in contempt of court” for refusing to issue licenses and for not allowing her deputies to distribute them for her. Some, like me, are calling on the local sheriff to arrest the federal judge. Why?

Good conservatives are conflicted because there are some competing principles in play. Conservatives are not lawless people, rather the opposite. We rightly affirm the proper place of law and government as good things God has ordained. So, it feels uncomfortable to be the ones protesting and otherwise stirring up things. We’re the “reasonable” ones. It’s the crazy liberals that want to burn everything down.

Unfortunately, the inmates are now running the asylum. The liberals on the Supreme Court have taken a match to the very foundation of our society; marriage. In the name of equality they have rendered an opinion that homosexuals ought to have the same right to marry as heterosexuals.

This is creating moral and civil chaos. There is absolutely no basis for this ruling in God’s Law, which has served as the basis for Western Civilization for centuries, our jurisprudence especially included. There’s no basis for it in reason as the fundamental purpose of marriage is it exists to create children. Sodomy is a biological cul-de-sac.

Some argue there is no right for the Federal Government to even rule in the matter as marriage law is not a specific, enumerated constitutional sphere of Federal jurisdiction. The jurisdiction of marriage is reserved to the States and the people. The people of Kentucky voted to define marriage according to what has been always the case for according to historic Natural Law.

By the US Supreme Court rendering a bizarre, convoluted opinion in an area where they had no business, they’ve ended up pitting a citizen’s legitimate First Amendment liberty, the free exercise of a religious duty to God and neighbors, against an illicit, disordered and unnatural “right.”

Davis swore to uphold the Constitution, not the extra-constitutional social engineering of five black robed tyrants on the US Supreme Court. Is this the time to stand against an over reaching Federal Government? If so, it is poetic that Kentucky might be the birthplace of a modern nullification movement for conservatives. (By the way, liberals have been ignoring Federal Laws for years, like Sanctuary Cities for illegal aliens, marijuana laws, etc. None of them are in jail.)

Kentucky led the way in 1798 when it opposed the infamous “Alien and Sedition Act” passed by Congress that make it illegal to criticize the President and the Congress! This is an explicit violation of the First Amendment right of free speech and to freely redress your government for grievances.

Thomas Jefferson helped draft the famous Kentucky Resolutions. They were the first state to nullify the unconstitutional act and interpose themselves between the people of Kentucky and an overreaching Federal government. Kentucky courageously had to initially stand alone, but now history has vindicated them as more states eventually came around.

Where are the courageous conservative patriots of our era? Most have drank the cool-aid of judicial supremacy and need to awaken from their stupor. The smelling salts of Liberty will come as a shock to our collective conservative consciousness. It tells elitist Federal judges we are not bound by their extra-constitutional imaginations.

The logic for nullification is simple, but has very real consequences in a culture conditioned to believe the Supreme Court is the ultimate, last authority on all things legal.

Here is a simple logical argument for real constitutional law.  

• - There is a law above all of man’s laws that serves as the basis for all true laws.
• - That law is called the “Laws of Nature and Nature’s God” or “the Law of Nations.”
• - God who created us made us equal and free.
• - God gives man natural rights and duties to do what is right and good towards God and neighbor.
• - Legitimate government exists when free men delegate limited power to government to protect them and their God given rights and duties.
• - Whenever a state becomes destructive of man’s basic natural rights or what is good, the state has become tyrannical.
• - Manmade tyrannical laws or rulings have no legitimate authority, therefore they are void and unlawful
• - No one can be required to obey an unlawful order.

Kim Davis fits this pattern perfectly. She is right and our Founders, relying on natural, God-given law would agree. There can never be a natural right to sodomy, it is itself unnatural and sinful. Western Civilization has held that for centuries.

Governor Mike Huckabee said it well, “The Supreme Court now thinks it’s the Supreme Being.” Do you? What is the ultimate source of law, man or God? Up until recently our laws made sense because they were built on Natural law, now we are entering into an increasingly more humanistic tyranny that is creating havoc with our real rights. I stand with God and His Law and with Kim, will you!
