The President of the United States, according to the Constitution, Article 11 Section 2, can grant a pardon to anyone at any time.
Consider the Democrat dilema. Hillary Clinton will win the nomination against Bernie Sanders but is facing some very serious criminal charges that may arise from the on-going e-mail scandals and the Clinton Foundation fund raising.
President Obama has one very potent role in the current Presidential race.
He can pardon Hillary Clinton!
According to Wikipedia “A clemency may be granted at any time with or without the filing of a formal request and even if the intended recipient has no desire to be pardoned.”
This is one major area that the checks and balances do not work. Basically the President can simply over ride the judicial system. He is not required to justify or explain to anyone , including Congress.
In addition “The Pardon Cannot Be Overturned!”
Hillary Clinton did report directly to the President and did follow his orders. She was not just some rogue Secretary of State operating independently.
It is unlikely that Obama would risk his political reputation and want to expose himself to the mess by granting a pardon.
Hillary Clinton is unlikely to formally request one, since this would be viewed by many as an admission of guilt.
Hillary Can Pardon Herself!
President Obama can wait until the elections are completed, while the various Democrat controlled departments delay and stall the investigations. That strategy appears to be working quite well.
Hillary Clinton, according to the polls, is most likely to win, unless the GOP can present to the public a viable candidate that most can rally around.
Once elected president, and charges are filed, she can pardon herself!
