The Amicus Brief is being filed in support of Col. Conrad Reynolds’ Supreme Court case in which he has requested the court:

1. certify the two proposed ballot measures so he can gather signatures, and
2. remove two laws that hinder the process of the initiative.

The Amicus Brief is in support of removing those laws.

Here are some excerpts to clarify the reason behind the Amicus Brief:

The lawsuit, filed early last week by Conrad Reynolds and the Arkansas Voter Integrity Initiative (an entity created by Reynolds), names Secretary of State John Thurston and the State Board of Election Commissioners as defendants. Reynolds, a retired U.S. Army colonel, unsuccessfully challenged U.S. Rep. French Hill in the Republican primary in 2022. The plaintiffs are asking the Arkansas Supreme Court to certify the ballot titles and popular names of two proposed constitutional amendments so the group can begin gathering signatures in order to place the measures on the 2024 ballot.

Reynolds has run into the same problem as various other groups pushing proposed ballot measures on issues such as abortion, education and government transparency: Arkansas Attorney General Tim Griffin. In recent weeks, Griffin has refused to certify a number of proposals, saying they lack clarity, are unconstitutional, or have other defects.

One of the proposed amendments would require elections in Arkansas to be conducted with a specific type of paper ballots; prohibit voting by any kind of networked voting machine; and limit when, how, and by whom ballots could be counted. The other would limit absentee ballots only to people who could prove that they would not be able to vote in person because they are in a hospital, prison, or long-term care facility in the county where they are registered to vote, among other changes.

The case does not deal with the substance of the two proposed amendments, however. Rather, it challenges the attorney general’s constitutional authority to certify ballot measures in general and asserts that changes to the ballot measure process made by the state Legislature in 2023  are unconstitutional under Article 5, Section 1, of the Arkansas Constitution.

Privatization of our elections is dangerous and has caused us to be in an extreme election crisis now and forever, unless we do something quickly to secure the vote!

With the voting machines in place, voter fraud is rampant. 

However, we can have paper ballots where there’s a paper trail for accountability.

Here’s an article from Secure Arkansas entitled Electronic Voting Machines are Corrupt to the Core.

The ES&S Voting machines that are used in Arkansas have already been subject to vote fraud and can be linked to the internet via a wireless connection. Vote fraud can be pulled off in each county without the counties being aware of what is happening. Each county in Arkansas and all the counties in the other states MUST get back to paper ballots to help eliminate the massive vote fraud.

Here’s an excellent video of Colonel Conrad Reynolds in an in-depth discussion with Dr. Andrew Appel from Princeton University on the subject of Securing Our Elections With Paper Ballots and Hand Counts.

Their discussion includes:

• why touchscreen voting machines are a bad idea, and
• why hand count audits are necessary to have an election that is secure and can be trusted.

Andrew W. Appel is the Eugene Higgins Professor of Computer Science at Princeton University, where he served as Department Chair from 2009-2015.  His PhD is from Carnegie Mellon University.  He works on methods and tools for verifying the correctness of software; on cybersecurity; and on technology policy, especially voting system security.   He has published over 140 scientific articles and books, and about 90 blog articles on freedom-to-tinker.com explaining voting system technology and security issues to the public.  Professor Appel coauthored the National Academy of Science 2018 study Securing the Vote: Protecting American Democracy.

Dr. Andrew W. Appel filled an Expert Report of Andrew W. Appel in the United States District Court for the Northern District of Georgia Atlanta Division Case 1:17 – cv-02989-AT Filed 01/09/23.  Some excerpts of this case are listed below:

20.   It is a clear scientific consensus that any computer-based voting machine can be “hacked,” in the sense that an unauthorized person can install fraudulent software that misrepresents votes and tabulations.

21. It is a clear scientific consensus that the only practical solution to this  problem (that is secure enough for use in public elections) is to mark votes on voter-verified paper ballots that can be recounted or audited by hand, in case the computers have (through fraud or inadvertent misconfiguration) counted the votes incorrectly.

22. There is clear evidence, and a growing scientific  consensus, that paper ballots marked by touchscreen ballot-marking devices (BMDs) are not voter-versified in a strong enough sense to secure elections, and there is no known way of remedying the problem —-other than to abandon BDMNs except for those voters who cannot mark a paper ballot with a pen.
