The Money Laundering and Asset Recovery Section’s (MLARS), Program Management and Training Unit (PMTU) is responsible for several nationwide law enforcement initiatives, working groups, and programs, including the transfer of forfeited funds to victims of crime and the Equitable Sharing Program. Each of these programs involves the transfer of hundreds of millions of dollars and requires consistent nationwide policies and oversight to ensure appropriate distributions.
This position is assigned to the PMTU as the Equitable Sharing Program Manager and a senior attorney in the Unit. The position will oversee all matters related to the Equitable Sharing Program, which authorizes the federal government to provide an equitable share of the net proceeds of forfeiture to any qualifying state, local, or tribal law enforcement agency that participates in an investigation or prosecution resulting in a federal forfeiture. The successful candidate’s responsibilities will include:
- Establishing long and short term program goals and objectives for the Equitable Sharing Program, including performance objectives and performance measures;
- Providing direction and technical oversight of the Agreements, Certifications, and Audit Team; the Compliance Review Team; the Program Analyst, and the equitable sharing training coordinator;
- Establishing written policies, operating procedures, and training materials;
- Planning, directing, and managing the policies, processes, procedures, and controls relating to all facets of the Equitable Sharing Program, including implementation across multiple Departments and agencies participating in the Asset Forfeiture Program;
- Analyzing and providing legal guidance on complex policy questions involving all aspects of equitable sharing, including application of guidelines and policies, agency eligibility, permissibility of expenditures, and sufficiency of audit findings;
- Assisting in the coordination, facilitation, and development of communications with federal, state and local law enforcement agencies on the Asset Forfeiture and Equitable Sharing Programs;
- Acting as MLARS’ Primary liaison with National Law Enforcement groups (e.g., National Sheriffs Association, International Chiefs of Police) as well as with State and Local Auditor Associations to ensure compliance with Standard Accounting Practices;
- Serving as a primary technical authority for U.S. Attorney’s Offices, investigative agencies, custodial agencies and the Asset Forfeiture Management Staff (AFMS) on all facets of the Equitable Sharing Program; and
- Serving as MLARS’s primary point of contact with the DOJ/OIG, Office of Justice Programs, OMB, and other relevant working groups to support and respond to requests and issues pertaining to audits of Program participants.
Interested applicants must possess a J.D. degree, be duly licensed and authorized to practice as an attorney under the laws of any state, territory of the United States, or the District of Columbia, and be an active member of the bar in good standing. To qualify at the GS-15 grade level, applicants must have at least four (4) years post J.D. legal experience, one of which is specialized experience at, or equivalent to, the GS-14 grade level. Examples of specialized experience include: independently performing legal analysis; composing pleadings, briefs and other court documents involving unique and difficult legal issues in civil or criminal litigation; conducting highly complex civil or criminal litigation; and leading paralegals and support staff.
