OKPay was ordered to hand over $6.1 Million to Mt. Gox

Payment processor OKPAY has revealed it was court-ordered to return nearly $6.1 million of withheld customer deposits to the failed company. The individual customer deposits were being held by OKPAY for transfer to MtGox when it filed for bankruptcy.
Angry OKPAY customers say company management failed to honour a “promise” made in mid-August that it would ensure they got their money back through their OKPAY accounts.
Vexed OKPAY depositors have put out a call on Bitcoin Talk seeking claimants to join in a EUR1 million class-action lawsuit against OKPAY to recover the lost deposits. But according to OKPAY CEO Konstantin Romanovsky, MtGox managed to convince a court in the British Virgin Islands (where OKPAY is registered) to rule that the funds go directly to the MtGox Trustee Fund instead.
“Initially, we fought for the right to return the money directly to customers, but Mt Gox forbade us to do so,” Romanovsky told Coindesk. “We reached the court, which eventually ordered us to pay the money [into the] Mt Gox Trustee Fund, and not to send money back to customers. As a result, we have fulfilled the court’s decision in the BVI and recently sent money [...] We understand that for our business’ overall image it would be better if we could send money back to them… But we had no other choice, and the decision of the court is already an undeniable factor.”
