NYC Landlords Are Fighting Back Against the Mamdani Rent Freeze (Video)

The freeze is scheduled to take effect on October 1, 2026, locking in a 0 percent rent increase for approximately one million rent-stabilized apartments across both one- and two-year lease renewals through September 30, 2027. 

The lawsuit alleges that Mayor Mamdani intentionally compromised the independence of the New York City Rent Guidelines Board (RGB) by packing it with loyalists. Shortly after taking office in January 2026, Mamdani appointed five new members to the nine-seat panel, creating a 6-seat voting bloc that pushed through the 7–1 freeze vote in late June. Property owners are leaning heavily on the high-profile resignation of board member Christina Smyth just hours before the final vote. In her resignation letter, Smyth wrote that the rebuilt board was strictly required to deliver a rent freeze and that everything else—the public hearings, data, and testimony—was merely “theater.” Landlords claim the board ignored statutory mandates requiring them to consider the real estate industry’s financial health. According to the board’s own Price Index of Operating Costs, landlord expenses surged 5.3 percent over the past year—fueled by an 11 percent hike in fuel and a 10.5 percent jump in insurance—yet the board chose a 0 percent adjustment. Property owners also accuse the board of blending income data from market-rate units to falsely inflate the financial health of fully rent-stabilized buildings. 

The plaintiffs, represented in part by prominent attorney and former deputy mayor Randy Mastro, are asking the court for immediate intervention. They want a judge to completely throw out the 7-1 rent freeze decision. They are requesting that previous rent increases (3 percent for one-year leases and 4.5 percent for two-year leases) remain in place while the issue is reconsidered. The suit demands expedited discovery and access to all communications between the RGB, City Hall, and the newly created $53 million Office of Mass Engagement, which mobilized tenant advocates ahead of the hearings.

The Mamdani administration stands firmly behind the freeze, calling it a historic victory for New Yorkers squeezed by an unprecedented housing affordability crisis. A mayoral spokesperson asserted that the Rent Guidelines Board operated as a lawful, independent body that balanced data from both sides, adding that the city’s Law Department is fully prepared to defend the freeze in court. Tenant advocacy groups, including the Met Council on Housing, have lambasted the lawsuit as a billionaire-backed effort to manufacture artificial panic and strip safety nets from working families. The city and the landlord coalition are scheduled to meet before a state supreme court judge on September 2, 2026, to hash out the policy’s fate before the October implementation date.
