The Supreme Court Just Denied Your Constitutional Rights (Video)

In this 23 October 2026 published video, host Michael Bordenaro talks with Mitch Vexler about how on October 5, 2026, the Supreme Court of the United States officially denied the petition for a writ of certiorari in the case Mitchell Vexler, et al. v. Don Spencer, et al. (Docket No. 26-179). By denying the petition, the Supreme Court declined to review the case or hold oral arguments, leaving the lower Texas state court decisions intact without validating or ruling on the merits of Vexler’s constitutional claims.
Vexler, a Texas real estate developer and founder of Mockingbird Properties, filed a series of lawsuits against the Denton Central Appraisal District (DCAD) and its Chief Appraiser, Don Spencer. Vexler functioned as a whistleblower, alleging systemic property tax fraud. He argued that local appraisal districts were intentionally inflating property values to artificially boost tax revenues, which he claimed supported unsustainable school bond programs and violated the Uniform Standards of Professional Appraisal Practice (USPAP).
The case escalated to a federal question when the Supreme Court of Texas (SCOTX) twice denied discretionary review. Vexler and his legal team argued that Texas state laws were being applied to shut down judicial discovery into government fraud. Vexler contended that limiting a property owner’s challenge exclusively to an administrative appraisal review board—which lacks discovery and subpoena powers—effectively bars citizens from obtaining a meaningful judicial remedy for systemic government fraud. The petition alleged that preventing a full adjudication of evidenced fraud claims constituted a “constitutional harm” and a deprivation of federal rights under the color of law, implicating the 1st, 5th, and 14th Amendments.
Vexler’s legal representation filed a Petition for Rehearing with the U.S. Supreme Court on October 13, 2026. Statistically, the Supreme Court rarely grants rehearings once certiorari has been denied, meaning the lower court dismissals regarding jurisdiction and government immunity stand as the final legal outcome in this specific challenge. Vexler has publicly stated intentions to escalate his findings to the Department of Justice.
