Lawfare: American Civil Liberties Union (ACLU) vs. Donald Trump

I noted today’s news item about an American judge who’s issued a temporary halt of Trump’s deportation of the refugees who’re beached at airports.

What we should always do in these situations is ask two questions:

i) Which judge is taking this action? And

ii) Which institution has brought the case (for the judge to hear)?

As ever, we have a case of Leftist lawfare versus voter-democracy here.

As it is, the ruling came from federal Judge Ann Donnelly (in New York). She’s effectively prevented the removal from the US of people with approved refugee applications, valid visas, and “other individuals… legally authorised to enter the United States”.

What’s more, the emergency ruling said that there was a risk of “substantial and irreparable injury” (what does that mean?) to those affected.

In this instance it was American Civil Liberties Union (ACLU) which filed the case. The ACLU is at war with Donald Trump and it is so on every conceivable front. (Simply download its website to see.)

Take these titles from today’s ACLU website (all on the front page):

‘He [Trump] Discriminated, We Sued’,

‘ACLU Blocks Trump’s Unconstitutional Muslim Ban’,

‘Trump Begins His Unconstitutional Program of Anti-Muslim Discrimination’,

‘We’ll See You in Court: Why Trump’s Executive Order on Refugees Violates the Establishment Clause’,

‘Demand Transparency from Trump’, etc.

Unlike Hope Not Hate, and even the Southern Poverty Law Center, the American Civil Liberties Union doesn’t hide – or dissimulate about – its far-Left politics. And neither does it hide – or be modest about – the sense of power it has over the democratic system.

What we have here, again, is Leftist lawfare. More specifically, we have:

non-democratic non-governmental organisations (NGOs) and law firms vs. a democratically-elected President.

Indeed all the places in which Leftism thrives function and exist without the public vote and without the people’s endorsement. That’s not strange: Leftist activism is anathema to most voters. Thus these Gramscian (or Salinskyian) “institutions” run parallel political systems: parallel to government, local councils, the law (they are the law) and so on. Politics and even revolution itself are slyly carried out under the noses of voters. This is the revolution – or the “radical restructuring of society” – which has been going on since the 1960s (if not before).

In terms of the details of the present case. Trump’s executive order has halted the US refugee programme and, in addition, instituted a 90-day travel ban for nationals from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen. Clearly, Leftist institutions – such as the ACLU – will fight tooth and nail against policies like this which work directly against socialist internationalism.

Trump himself, however, is happy with how things are going. He told reporters:

“It’s working out very nicely. You see it at the airports, you see it all over.”
