Good News From Austria – In Case of Mandatory Vaccination, Never Pay the Fine But Challenge It Legally

Now we are getting a clearer picture as to why there are difficulties and delays. Of note:

Over 84,200 statements have been received on the controversial Austrian vaccination law. A particularly explosive document was submitted by the umbrella organization of administrative judges (DVVR) on January 10 : In their statement , the administrative judges came to the conclusion that prompt implementation of the Covid vaccination obligation is simply not possible. This is mainly due to the fact that politicians are ignoring the enormous additional workload for the administrative courts that will arise from the expected mass of lawsuits.

The draft law for compulsory vaccination in Austria assumes the following numbers of administrative penal proceedings in the coming years (quoted from the statement of the DVVR, read here):

The draft estimates in its explanatory notes that compulsory vaccination will result in 1,400,000 administrative penal cases in 2022, 400,000 in 2023 and 40,000 in 2024, with 100,000 cases in 2022 and 30,000 and 30,000 in 2023 and 2024, respectively 3,000 cases the administrative courts (of the federal states) are appealed to; the time required for each administrative procedure is estimated at 3 hours in the draft.

However, the umbrella organization of administrative judges considers this to be too low. Apparently, according to the judges, the resistance to compulsory vaccination in the population is underestimated:

From a legal policy point of view, it is to be expected that those requiring vaccination who have not yet made use of the vaccination offer will try to defend their previously taken positions by making use of legal protection, and to a greater extent than expected in the draft.

Against the background of the current social discourse about compulsory vaccination, not only is an appeal rate of less than 10 percent an optimistic low estimate, but the time required per case is also unrealistically low, because in numerous cases complaints are to be expected, which will result in the appointment of experts by the administrative courts, as shown by the numerous administrative penal proceedings based on the COVID-19 Measures Act.

According to the statement, the figures mentioned in the draft law would require at least a doubling of the number of judges in the administrative courts in 2022. However, how this is to be implemented remains completely open – politicians do not seem to have given much thought to that.

Good grief. Where is the PRINCIPLED opposition to this tyrannical ‘law’ by our esteemed judiciary?

A reminder that despite the law having been passed for February 1, 2022 implementation, the punishment for those defying the law will not come into effect until six weeks later, March 15. Which is strange. This law had first been announced in November.

The party was founded on February 2 of last year, 2021, presumably as a response to the Covid scam.
