New Finanical Regulations for Lower Earnings

There is a lot of talk that the Senate is close to a deal on new financial market regulation.One of items reportedly being discussed is  a new bankruptcy process for non-bank  financial companies that are in trouble. In this scenario the Fed and other government regulators (including the Tresury Secretary) could  force any financial company to be dissolved by the FDIC if they deem such is neccessary.

Investors should watch this closely-in terms of their investments. Should this come to pass it would mean some big changes for companies in this sector of the financial industry. These companies will really have to keep an eye on their overall capital structure so as to keep the government out of their way. However, it also means they will be under evem more pressure to comply with the spirit of the Community Reinvestment Act (CRA) and other programs.This will most likely lead to companies with more capital, less  leverage and smaller (and therefor less profitable) credit assets.

As the current regulation target of the days large non-bank finanical companies are up for more more regulation-and this ususally means lower profit margins and earnings in the long-term. Investors should take a hard look at companies like Capital One (NYSE:COF) or Discover Finanical Services (NYSE:DFS) in the group
