Following a Supreme Court decision that allowed the Trump administration to end Temporary Protected Status (TPS), approximately 350,00.0 Haitians nationwide—including thousands in New York City—have lost their legal protections and work authorization. The U.S. Supreme Court ruled 6-3 that the Department of Homeland Security can end temporary legal protections for around 350,000 Haitians and 6,000 Syrians. Haitians originally received TPS after the catastrophic 2010 earthquake because conditions in Haiti were too dangerous for return. The administration argued that the program was meant to be temporary. With TPS expired, recipients lose their legal status and work permits, making them vulnerable to deportation.
NYC operates as a sanctuary city, meaning local police and agencies generally do not cooperate with federal immigration enforcement (ICE). Sanctuary policies protect undocumented immigrants from local law enforcement handovers, but they do not overrule federal law or stop federal ICE agents from carrying out deportations. NYC Mayor Zohran Mamdani and local advocates have publicly criticized the federal decision and pledged support for affected residents, even as the city faces federal pressure to comply with employment and immigration rollbacks.
Work permits and related documents for former TPS holders have expired, leaving many people in legal limbo. [ICE has started carrying out deportation flights to parts of Haiti deemed safe enough to land, such as Cap-Haïtien, despite ongoing gang violence in other regions like Port-au-Prince.
