Congress incharge for Punjab Gulchain Singh Charak today said that the issue of the 1984 anti-Sikh riots must not be politicised and the law should take its own course.

Talking to the media at Bishengarh near Malerkotla today, he said the “black chapter” should be forgotten.

While giving the party ticket for the coming assembly elections, the performance of sitting MLAs would be weighed and the decision taken by the high command adhered to.

With the awarding of 10 years’ imprisonment to former navy officer Emile Jerome and his girlfriend Maria Susairaj, who is a Kannada actress, to three years in the Neeraj Grover murder case, legal eagles have once again raised doubt over the way our prosecution agency is working.

Criminal lawyer KTS Tulsi said, “This case is no less than infamous Tandoor case, where Sushil Sharma, the main accused in the case, was sentenced to death for brutally killing his wife and then dousing her body in Tandoor. The case of Neeraj Grover was also on the same lines.”

“I don’t understand why the court has taken a different view on this issue. Another reason of court taking this stand is lack of supporting evidence. Prima facie it seems that the prosecution failed to establish the missing links in the story and this is where lacunae by the court were found,” Tulsi said.

In the Tandoor murder case, Naina Sahni was killed by her husband Sushil Sharma, a Congress MLA. Naina was also a Congress party worker.

Three years after Neeraj Grover was killed and his body hacked into pieces and disposed of in a forest in Thane, the court had absolved Maria and Jerome of murder charges after holding them guilty of lesser offences.

Criminal lawyer Ramesh Gupta said, “Any amount of good investigation would not result in success unless the institution of prosecution has officers who are of merit. This part has been weak and somewhat neglected. Its recruitment, training and professionalism need special attention so as to make it synergetic with other institutions and effective in delivering good results.”

“In this case for lesser punishment, it is the prosecution who is responsible. Had the weaving of facts been correct, the court would not have given this punishment,” Gupta added. Even the government has earlier mooted the idea of independent directorate of prosecution so that cases don’t fall flat.

Former CBI chief Joginder Singh said, “Until and unless our prosecution is strong we will not able to achieve high rate of conviction in such cases. This trend will lead us nowhere. Criminals will continue to be let off easily.”

They bolster their influential relation with SSP/Army and assert authority in despicable manner.

 

Recently we have seen nation awaken from slumbers when LEADERS are SEEN talking about ANTI-CORRUPTION, I wonder how shall they ever achieve or accomplish their aim of curbing corruption if not eliminating?

NATH’S RESPONSE TO U.S. COURT IN 1984 SIKH GENOCIDE CASE

 

New York: (June 30, 2011)

Kamal Nath through his attorneys has filed answer to the summons issued by Judge Robert W. Sweet of the US Federal Court for the Southern District of New York.

 

On June 24, 2011 Kamal Nath submitted response in the court taking defenses of (a) entitlement to Immunity; (b) lack of service of summons and complaint; (c) plaintiff’s lack standing. In his answer to the US Court, Nath claims Diplomatic Immunity because he was on Special Mission to New York; Sovereign Immunity under Common Law; and Immunity under Foreign Sovereign Immunity Act (FSIA) of the United States. Requesting the Court to dismiss the law suit, Kamal Nath filed a sworn affidavit that during his April 2010 visit to New York, no one ever served him with the Summons and Complaint.

 

Nath’s affidavit submitted to the court on June 24, 2011 clearly and blatantly contradicts his earlier statements.  On April 06, 2010, Nath publically acknowledged receiving the summons and stated “A piece of paper was given to me. I will have to see what the piece of paper is all about”. “I really have no clue about it. I don’t have a basis and I don’t know the authenticity. I don’t know the validity. It was for the first time that I saw it”.
