Fix this email a little bit and send it to a few different talk shows.  Maybe we can get someone to interview the Senator that is in charge of the Senate Judiciary.  This might be helpful.

You asked me how you could help. I really need some but I really don’t know what to do.  I have been attempting to offer some of my ideas to the country to try to get some political help for political prisoners, and Rudy has been really doing a great job.  He is the best.  Here are a few ideas
1.     I really need to have someone pray for  us.
2.    Maybe you could invite Senator Grassley on your show, to talk about the Judiciary, as he is the Senate Judiciary Leader; and remember my father paid him and Ed Snook over at the U.S. Observer $10,000 to try to help me; and on this web site Ed Snook claims that he works with Senator Grassley to help prisoners.   You also have the letter that I mailed to Senator Grassley.  You could point out my fathers book called the Cesspool of Judicial Corruption.  What I trying to say, is that as a talk show host, you have the ability to reach out to these very important people, and they will let you interview them.  It is my understanding now that Senator Grassley really does not like the corruption in the Judiciary and that is why he is worked with the U.S.Observer in the past.  If you look at the website, the U.S.Observer.com, you will notice that Ed Snook claims to work with Senator Grassley, and they have already helped, they claim over 4,000 prisoners.  So, really I was supposed to already be getting some help from Senator Grassley.  But Rudy has told me that he does not trust Ed Snook.  I don’t know what this means as I think that we maybe need to interview the Senator.  Let me know what you think about this.

   I will finish a new brief with my jail house lawyer and wait for the Dimaya case to get ruled on.  If we could somehow push Senator Grassley just a little bit about when this Dimaya case is going to get ruled on this would be helpful also.
  The problem in the past has been that they have ruled wrong against me every step of the way.  Remember I even won my direct appeal and they then reversed my win and created a whole new legal standard just for me.  It is called the Hinkson Standard.  This is a violation of the Expost Facto Clause of the constitution.
   Mark Levin claims to be such a legal expert, and I have heard him say that if you are in prison you must have done something.  I want you to know that I will stand ready to debate Mark on a minutes notice.
   I really do have the post case of bad.

Mobile & Web-Based App Launched by NVLSP to Help Military Veterans and Advocates

NVLSP launched a first of its kind app for use by military veterans and their advocates, known as the NVLSP VA Benefit Identifier. The app helps veterans determine specific VA benefits to which they are likely entitled. It can be used with or without the assistance of a veteran’s service officer.

 

The app directs users to a logic based questionnaire that assists in verifying whether a veteran should file a claim for service-connected disability benefits or nonservice-connected disability pension. To protect privacy, no data or personally identifying information is retained. Once the questionnaire is completed, results can be emailed or printed and used as a reference when filing claims for VA benefits.

 

The app is available in English and Spanish. It can be downloaded through the NVLSP website, the Apple App Store, or the Google Play Store.

The App

More Than 133,000 Wounded Warriors to Benefit from NVLSP Supported Legislation

A tax refund will be coming to more than 133,000 eligible wounded warriors who were improperly taxed on their severance pay by the Department of Defense (DoD).  The refunds are the result of congressional legislation supported by NVLSP.  Attorney Tom Moore discovered that the government had been wrongfully taxing injured veterans on their severance pay since December 17, 1991.  Litigation could not fix this problem for the affected veterans.  Only legislation could truly help.  U.S. Senators John Boozman and Mark Warner introduced bipartisan legislation to fix the problem, known as the Combat-injured Veterans Tax Fairness Act. Identical legislation was introduced by Congressman David Rouzer.  The legislation passed both houses and was signed into law.  DoD is now sending letters to eligible veterans with directions on how to request their refunds.  NVLSP Senior Staff Attorney Tom Moore spoke with WJLA – ABC7 in early February about the legislation. 

Victory for a Veteran

U.S. Army Specialist Starks served honorably in the military for three years from March 2005 to December 2008. During his deployment in Iraq, he was exposed to fire fights and mortar attacks. Consistent exposure to these traumatic events began to negatively affect him. He experienced sleep deprivation due to severe nightmares. He became irritable and was deemed a danger to himself and his unit.

Upon his return home in 2008, Specialist Starks continued to experience mood swings, nightmares, insomnia, irritability, and other post-traumatic stress disorder (PTSD) symptoms. He was soon examined by the Army Physical Evaluation Board (PEB). The PEB determined that his PTSD had manifested because of his symptoms of anxiety and severe sleep disturbance, not due to his deployment-related experiences. The PEB placed him on the Temporary Disability Retirement List (TDRL).

 

Specialist Starks was reevaluated by the military in December 2009. The examining psychiatrist diagnosed him with a condition called Intermittent Explosive Disorder (IED), instead of PTSD, after just one examination. IED is not a qualifying disorder for disability retirement. Ignoring many years of PTSD symptoms and treatment, the PEB decided that his PTSD-related symptoms only warranted a 10% disability rating and that any additional impairment was due to IED. By May 2010, the Army had taken away his retirement benefits and Specialist Starks no longer had access to military healthcare for himself or his family.

     

Three years later in 2013, Specialist Starks called NVLSP. A staff attorney determined that he was wrongfully denied disability retirement. With the guidance of NVLSP’s team and attorneys from Hunton & Williams, we applied to the Army Board for Correction of Military Records (ABCMR) to rectify the situation. In 2017, Specialist Starks, seven years after he lost his retirement benefits, won his long battle for justice. Specialist Starks was permanently retired from the military due to PTSD. The retired veteran and his family can now access healthcare and other benefits as a result of this victory.

STAFF SPOTLIGHT

Jill Davenport, Attorney

Jill Davenport is an Appelate Attorney. Her primary responsibility is to provide direct representation of veterans in front of the Court of Appeals for Veterans Claims. The majority of Jill’s cases deal with service-connection claims or increased ratings claims. She completed her law degree from the University of Alabama School of Law. 

Jill’s interest in veterans law is due to her strong family ties to the military. She saw her father-in-law, a Special Forces paratrooper, struggle to apply for disability benefits, and realized that she wanted to focus on veterans law. “This is an area of law where you can do a lot of good for people all of the time,” said Davenport.

 

After beginning her legal career with NVLSP immediately after graduating law school, Jill now takes on approximately 85 cases at a time and personally screens an average of 50-60 cases per month. When asked what aspect of her work she finds most rewarding, Jill says it is getting to know each veteran and hearing their stories of service. She explained that many client relationships have extended beyond the litigation process. She recalled working with a widow whose husband passed as a result of emotional and physical pain from post-traumatic stress and a gunshot injury. The VA claimed the veteran was an alcoholic and denied benefits. Jill worked diligently to prove service-connection to the cause of death and won $180,000 in back pay for the widow.

 

One of the most important aspects of her role is acting as a translator to facilitate effective communication between veterans who have no experience with legal matters and the Board of Veterans’ Appeals. Jill sees many clients waiting an average of eight or nine years before entering the court room. As a large number of claims sit idly at the regional office, Jill works to get the case back on track by revising those claims and ensuring that the documentation narrows in on legal points needed by the VA to qualify the claim.

 

After 3 years at NVLSP, Jill also helps mentor volunteer attorneys through the Veterans Pro Bono Consortium Program. Mentees in the program have little to no experience in court. Having been in their shoes just a few years ago, Jill brings the experience and understanding needed to approach pro bono cases. She is as dedicated to the young attorneys as she is to the veterans she represents, striving to achieve a favorable resolution in court. She is careful not to overlook explaining things like filing a notice of appearance and assists in each aspect of the case to ensure every veteran receives the best possible representation. Jill personally takes time to assist attorneys in reviewing the veteran’s claim files and records while also giving attention to draft memos, court briefs and support in formulating arguments regarding VA errors.

 

Speaking regularly before court rooms and other attorneys, Jill has earned a reputation as a strong public speaker. She has frequently been invited to lead webinar and live training sessions presented by NVLSP.

 

Looking to the future, Jill plans to continue her work with NVLSP’s training and mentoring programs. “In the time it would take for me to assess ten cases, I could train 10 attorneys, allowing them to assess 10 cases each, which assists 100 veterans,” says Davenport. “I look forward to that mode of working to help grow the number of attorneys with the ability to assist veterans and acquire faster and more favorable results, rather than having them languish in the system for 10 – 15 years.”

I enjoyed talking with you more than you will ever know.
You asked what you could do to help. I had an idea yesterday.
About three years ago, Wesley Hoyt had given $10,000 of my WaterOz money to a guy named Ed Snook.

* Ed owns the U.S. Observer national magazine. I called and talked to Ed Snook, and he told me that he was working with Senator Grassley of the Judiciary Committee, and $10,000 is the fee they charge to help innocent people get out of prison.

He also told me that they had gotten over 4,000 people out of prison who were wrongfully incarcerated. I then complained to Ed about what this Hoyt was doing, as he was trying to steal my WaterOz business, and my father had lost his mind (in my opinion).
At this time I was told by Ed Snook, to not fire Hoyt or Roland as he was able to work with both of them. Of course I had no choice as I had to fire my father from my POA to get rid of the Hoyt guy.
So, I then wrote Senator Grassley four times. I mailed letters to both of his address, as he had one address in Iowa and the other address in D.C. I then never heard back from him.
So, in summary I have already paid Ed Snook, and Senator Grassley for their help.
Now when I got a business card from Rudy Davis, I noticed that he had Ed Snook’s U.S. Observer Information on his card. Now Rudy told me that he thinks that Ed Snook is taking money from innocent political prisoners and they do not help them.

If this is true it means that Senator Grassley has worked with Ed Snook in a way that might be inappropriate.

So, here is my idea, as a person who has a great talk show, you could invited Senator Grassley to come on your show, and you could ask him if he is and has been working with Ed Snook to help prisoners.

Then you could ask him some question about why he does not answer letters or take calls from voters. My friend Denise lives in Iowa and Grassley has not responded to her.
Note that last time I talked to Ed Snook, he told me that if I ever got a Y-Tube Video showing the GALT Motor working that he would be able to use it to get me out of prison. I have not talked to him since.
I’m now told that Guy has found my Grassley letter and is sending it to you today.
It now would seem that you have the only talk show that would ever speak for the wrongfully incarcerated. I think this is why they might have run you off of the Coast to Coast.
Just an idea: I had the idea of creating a national talk show in the future called “Shore to Shore” and I thought that we could start our show two hours earlier than Coast to Coast and slowly take the show away from George. We have talked about different ideas of using the GALT Transformer Motor to actually feed the Grid and every radio station to pay for the air time.

This would allow us to be able to afford to pick up many stations. I know for instance that a lot of stations just give the Coast to Coast air time for free as there is not a lot of demand for the late hours. I really like the idea of having a format like Art Bell used to have but earlier in the day. Anyway this was just an old idea.
I talked to Scott Cantor in Las Vegas and he said that in his opinion, selling energy for a 50% discount would be like selling sun shine.
Anyway thank you again for the great interview and I hope that maybe we can figure something out to help people that are wrongfully incarcerated.
