On May 9th, 2014 Marvin Louis Guy was nicely tucked in and asleep in bed with his wife in their Killeen home. At around 5:30am there was a commotion as his house was being invaded. Startled by men coming in through his window and fearing for his life he did what anyone would have done, he grabbed his gun. It was all over in a couple seconds and Marvin and his wife were still alive. Thankfully he was armed and was a hero for saving his wife’s life from imminent death. He had shot four men in total. One of the thieves was hit in the face, one in the thigh and two bad guys were hit in the chest. All of this perfectly legal in Texas with S.B. 378 “Stand Your Ground” law in place. He had nothing to worry about as everything seemed cut and dry, except for one small detail.

The home invaders were also members of the Kileen S.W.A.T. team. They were doing a no-knock raid on a citizen under the cover of darkness and with no proof or evidence of any wrong doing. An informant, usually some low level druggie that gets caught with drugs, tipped off police that Marvin might be in possession of an illegal substance with intent to sell. That was all they thought they needed to have the judge sign a warrant. Although much of Marvin’s private property was stolen from him during the raid like his laptop and 9mm pistol, no drugs were found.

Two days later one of the intruders died from his injuries. Marvin Guy, 49 at the time of the incident, was charged with capital murder in connection with Dinwiddie’s death and three additional counts of attempted capital murder for wounding the other officers. It is a great tragedy when a man who used self-defense in his own home is being put on trial. The state is seeking the death penalty and has refused to replace his court appointed lawyers that have made racist and unprofessional remarks to him. In an August letter written from jail Marvin asked that two of his attorneys, Michael White and Russell Hunt Sr., be dismissed from the case. Marvin said Hunt, a veteran death penalty defense attorney, made “vindictive” and “unprofessional” comments to him. “(Hunt) stated when I asked to diversify a jury, ‘Oh so I guess you want a black judge and a black jury, too’,” Marvin wrote. Gauntt denied Guy’s request to drop his defense team in September.

This case is being set up to be the case-law that dissolves the 4th amendment. If we stand by and let this case go to trial in their kangaroo court we will all lose. Marvin may lose his life and all Texans will lose their right to privacy and right to self-defense. This is not just another mishap by the police or one bad cop violating a citizens rights. This case will have a reach far worse, one that will make it illegal for you to defend yourself against a thief or a rapist if he happens to also have a shiny badge. We can all agree that there are a few bad apples in any group of people and giving immunity to the police in this situation is reckless and unjustified. Claiming the right to prosecute people who defend themselves when someone is breaking into private property unannounced goes against all that it is to be a free American. And not for nothing let us mention the dangerous practice of nighttime no-knock raids. Their poor thought out excuse is that a criminal might flush evidence if they are alerted. But is that worth the risk of a policeman’s life? A much safer policy would be to watch a residence and confront the individual while they venture out to the store for food. Instead they consciously decide to play stupid games which inevitably wins them stupid prizes.

Where is the outrage? What can we do to see this injustice made right? This man needs to be immediately released and compensated for his suffering, grief and hardship. We will obviously be doing an event at his trial but that isn’t enough. We want everyone to get involved. He is being held on a $4.5 million dollar bond for self-defense. It is an outrageous amount and does not fit his case.

An online petition asks that the capital murder and attempted murder charges against Guy be dropped. But that’s not enough either. Write your Governor, district attorney and congressman asking that this case be dismissed. Phone bomb the jail and the courthouse. Call the Killeen S.W.A.T. and tell them politely that they are ruining a man’s life and destroying all of our rights. All of our rights are constantly under attack but when they take your right to defend your own life it will all be over. You can not defend any other right unarmed, like a slave. Self Defense is a last resort right. Make this your wake up call. You don’t know this man, but you need to come to his aid. We all need to stand shoulder to shoulder, not just for a single life in the balance, but for our existence as free men and women. This is a pivotal case that will surely affect you. Do something about it. Now!
