We dont need no constitution

On this day January 30th, 1981 in history Canadian Parliamentary Committee accepts proposed native rights amendments to the Constitution. This was to lead the way towards Canada to be sovereign and not under paternalist rule of Britain.

The Constitution Act of 1982 section 35 was to enshrine the protection of Aboriginal and Treaty Rights of Indigenous peoples of Canada. Some of the rights were regarding fishing, logging, hunting the rights to land. Aboriginal title and the right to enforcement of Treaties. As well as recognizing the inherent right to self-government.

Any time the government is interacting with First Nations it is to be under the principle of the honour of the crown. This means the crown is to consult with First Nations regarding such things as industrial activity upon our territory, or any activity that might negatively affect our lands and life.

Our rights as indigenous people are a collective rights that are integrally tied to our occupation and use of our traditional lands. These are inherent rights that have been part of our culture, governance, society and law, since time immemorial. These rights include rights to land, to live off the land, self-determination and self-governance. These are not rights that are granted to us from the colonial state. The colonial oppressive state cannot even define what Aboriginal title and rights means or leaves to the courts to define, this is allowing the paternalistic,colonial system to control our lives and lands.

The very foundation of canada Royal Proclamation of 1763 outlines that settlers were to acknowledge Aboriginal Title & Rights, to recognize our sovereignty on a nation to nation bases.

Our rights be it historical Treaties or as First Nations have been infringed upon since contact and to this very day be it industry, corporations, development, First Nations have been continuously asserting our rights upon our lands, many nations have never ceded or surrendered their lands. A nation to nation bases does not allow for the state to be the dominate factor in our relationship. This is an issue for international law and human rights.

Canada’s relationship with indigenous has been and is still based on extinguisment of our title and rights, control of our lands and lives. continuation of resource extraction and corporate greed.

As indigenous people we can not trust in their system, we do not need their legislation or litigation to define our title and rights. We must uphold our tribal laws, natural laws and roles and responsibilities to the land, waters and future generations.
