GA Ballot Challenge Case’s Alleged Subpoena Questioned

Thanks to a heads up in a recent email I received, the BirtherReport.com site has a discussion going on about the alleged subpoena that is purportedly a part of the GA ballot challenge case.

The posting is based on an open letter to the blog editor questioning Dr. Orly Taitz’ motivations behind the subpoena.

Key paragraph:

Recently, Dr. Taitz has been stating on her website and elsewhere that Georgia Judge Michael Malihi has issued subpoenas related to her Georgia case, and she has even posted images of the subpoenas. Does she really think that people are that gullible? She has done nothing but download pre-signed subpoena forms from the Georgia OSAH website (www.osah.ga.gov) that are made available to attorneys involved in cases there. Even nobodies like I know that a Georgia Administrative Court doesn’t have the power to subpoena officials from other states! So, how dishonest is it for Orly to represent that Judge Malihi doesn’t understand that simple legal principle, and that he is issuing these subpoenas? Even if he did have that power, it would be a lie that his court issued the “subpoenas” that Orly is posting and gloating about. Downloading blank forms and filling them out is not the same as a judge-issued subpoena!

It appears the Georgia Office of State Administrative Hearings is on to Orly’s dishonesty now, because the link (http://www.osah.ga.gov/documents/subpoenas/subpoena.doc) they have for those blank subpoena forms is now dead!

The same link for the BirtherReport.com posting also displays a copy of the blank but signature-stamped subpoena that had been generally available for Georgia case usage.

However, according to one comment, a link to the Interstate Subpoena Deposition Service, the letter writer, above, may not be completely accurate in their understanding of such documents.

The bottom line is that if said subpoena was originally available online for Georgia-based attorneys to use and if Dr. Taitz is registered to practice law in Georgia, then it’s not completely out of the realm of possibility that she’s trying to compel Hawaii to produce documentation based on the “blank” subpoena in Hawaii, based on a Georgia case (as has been at least anecdotally confirmed in alleged conversations Dr. Taitz had with officials in Hawaii via my last posting).

So, if the document’s usage is legitimate, then it’s simply a matter of whether or not Hawaii is willing to honor it.
