Mr. President, What Exactly do you Think the Supreme Court's Job Is?

I’m no expert on politics, nor have I ever claimed to be.  The inner workings in Washington D.C. have become so complex and overblown, I’m not sure who can really grasp how things work.  Even at local levels, holding political office can be intimidating.  It seems to take career politicians, lawyers, liars, cheats, and con artists to figure out how politics work anymore.


I’ve written in the past about my simplified view of things, and while I sometimes question if I’m the one that’s wrong, I still believe politicians at all levels SHOULD have a pretty simple job.  I understand the principles of life, liberty, and the pursuit of happiness, I understand the fact the Constitution is not a fluid document open to interpretation, and I can balance a budget while spending responsibly.  There is no reason anyone with those abilities should not be able to make political decisions, but we have reached a point in our country where politicians write 2000 page documents full of fluff and unrelated legislation in order to pass an unconstitutional law.

While my political view may be simplified and limited, I have come to a very scary realization; I have a better understanding of politics than President Obama.

Obama, during a joint press conference Monday with the leaders of Canada and Mexico,
said he’s “confident” the law (Obamacare) will be upheld, but cautioned the
“unelected” court against reaching any other conclusion
. In doing so,
Obama invoked what he described as conservative concerns about judicial
activism

…”I’m confident that the Supreme Court will not take what would be an
unprecedented, extraordinary step of overturning a law that was passed
by a strong majority of a democratically elected Congress,”
Obama said.
“And I’d just remind conservative commentators that for years what we’ve
heard is the biggest problem on the bench was judicial activism or a
lack of judicial restraint, that an unelected group of people would
somehow overturn a duly constituted and passed law.
Well, this is a good
example. And I’m pretty confident that this court will recognize that
and not take that step.”

Where do you start with such an ignorant comment?

I’m not even going to take the time to do extensive research to prove my point on this one.  This has nothing to do with the overblown brand of politics we have today.  The ignorance behind Obama’s stance can be seen with the most basic knowledge anyone who has attended a public school in our country should have.

It’s called ‘checks and balances’ Mr. President.  You don’t make laws and you don’t determine whether or not they are constitutional.  A law being passed by elected officials does not automatically make it constitutional.   If you want to be upset over ‘judicial activism,’ let’s talk about the California Supreme Court overturning Proposition 8, which was voted on by the citizens of California.

I don’t remember President Obama getting upset about a court overturning laws passed by a majority in that case.

Not only does President Obama show a simple lack of understanding when it comes to checks and balances, it is quite clear he does not know what the Supreme Court’s job is.

I tried to find the most simplified explanation I could of the Supreme Court’s job so our apparently uneducated President can grasp the concept.

Through court cases, the judicial branch explains the meaning of the
Constitution and laws passed by Congress.
The Supreme Court is the head
of the judicial branch. Unlike a criminal court, the Supreme Court rules
whether something is constitutional or unconstitutional
—whether or not
it is permitted under the Constitution.

I learned this in elementary school in a small town of less than 2000 people.  Our President was supposedly an honor student at Harvard Law School….

Am I the one misunderstanding things, or does it appear our President has no understanding of the most basic principles in American politics?  If the Supreme Court can’t overturn a law once it has been passed, what exactly can they do in our system of checks and balances?

I agree with Mitt Romney for once….it’s time we redirect our attention to our arrogant Commander-in-Chief and his total disregard for the set of principles our country was founded upon.
