"Transgender" Illegal Aliens Exempted From Deportation

by JASmius

Actually, I was looking for the “Caitlyn” Jenner Vanity Fair cover only with the ex-Olympic Decathlete wearing a sombrero, but this’ll do.

Thus has the phrase “extranjero transgénero ilegal” been added to the Spanish language.  Not that Obamnesty didn’t already make them irremovable U.S. residents, but I suppose the Ninth Circuit Court of Appeals had fallen behind on their acts of either “public service” or badly comedic jurisprudence.

Okay, not so comedic, as the chico llamado Sarita is also a convicted felon:

Being transgender is the latest excuse for giving illegal [alien]s a free ride to sanctuary in the United States.

A federal appellate court ruled Thursday that an illegal [alien] could not be deported despite having a felony conviction because he’s a “transgender” who identifies himself as a woman and might suffer sexual and physical abuse if returned to Mexico.

A three-member panel of the 9th U.S. Circuit Court of Appeals, in San Francisco [natch] found that a federal immigration board had confused sexual orientation with gender identity when it ordered the deportation of Edin Carey Avendano-Hernandez, according to Reuters. [emphasis added]

Never mind that, how did the deportation order get past the Obamnesty dragnet?  I hope that federal immigration board’s members have updated their resumes.

The court also disputed a finding by the Board of Immigration Appeals that recently enacted Mexican anti-discrimination laws would afford protection to “transgenders”.

“Country conditions evidence shows that police specifically target the ‘transgender’ community for extortion and sexual favors and that Mexico suffers from an epidemic of unsolved violent crimes against ‘transgender’ persons,” Judge Jacqueline Nguyen wrote for the court.

Well, Judge Nguyen, that brings up a few responses to your argument: (1) That’s not our problem; (2) your job is to apply U.S. immigration law, not crusade for the interests of the Mexican freak “community”; and (3) if Mr. Avendano-Hernandez – who, I will remind you, as a non-citizen AND a felon, is entitled to no rights in this country – wants to avoid beatings, sexual assaults, rape, and whatever other varieties of abuse to which his return to his own country would make him subject, let him try not chemically mutilating himself and dressing like a transvestite and being normal for a change.  You know, making himself less conspicuous.  I know it’s crazy, but it just might work.

I know, I know, I’m blowing smoke up my own bloomers.  And any appeal to the SCOTUS is a waste of time.  But I’m an incurable optimist, I suppose.  So demandar me.
