Supreme Court Gives Half of Oklahoma Back to Indians

Just when you thought that current events could not get any crazier without Democrats taking over the White House first, the Supreme Court has given nearly half of the State of Oklahoma back to the Indians. Unreal:

The Supreme Court ruled on Thursday that millions of acres in eastern Oklahoma — including Tulsa, the state’s second-largest city — are still part of an American Indian reservation.

In a 5-4 decision, the Supreme Court agreed with a convicted rapist who argued that his 1997 rape conviction should be overturned because the state of Oklahoma lacked jurisdiction. Neil Gorsuch sided with the liberal wing, ruling that Congress failed to disestablish the 1866 boundaries of the reservation.

Even John Roberts, who has bent over backward to accommodate liberals on issues like ObamaCare and abortion, acknowledges that Congress had clearly transformed the reservation into a state.

“In 1997, the State of Oklahoma convicted petitioner Jimcy McGirt of molesting, raping, and forcibly sodomizing a four-year-old girl, his wife’s granddaughter,” Roberts wrote in the opinion joined by Justices Alito, Kavanaugh and Thomas. “McGirt was sentenced to 1,000 years plus life in prison. Today, the Court holds that Oklahoma lacked jurisdiction to prosecute McGirt—on the improbable ground that, unbeknownst to anyone for the past century, a huge swathe of Oklahoma is actually a Creek Indian reservation, on which the State may not prosecute serious crimes committed by Indians like McGirt. Not only does the Court discover a Creek reservation that spans three million acres and includes most of the city of Tulsa, but the Court’s reasoning portends that there are four more such reservations in Oklahoma. The rediscovered reservations encompass the entire eastern half of the State—19 million acres that are home to 1.8 million people, only 10%–15% of whom are Indians.”

As we learned from Obergefell v Hodges, it only takes five votes to impose any extreme of moonbattery, no matter how whacky and destructive. Ultraleft lunacy is guaranteed at least four votes.

Hundreds of dangerous inmates may have to be released from prison as a result of this grossly irresponsible ruling.

As Roberts points out, “the Court has profoundly destabilized the governance of eastern Oklahoma.” Uncoincidentally, destabilization is at the heart of the Hard Left’s strategy to dismantle our system and replace it with authoritarianism.

It will be interesting to see what effect this has on voting status. What better time than right before an election to throw voting into question in arguably the reddest state in the nation?

Considering that the Supremes are this reckless if not malevolent now, imagine the situation after Joe Biden has been in a position to nominate whatever recommendations he is handed by the radicals currently steering the Democrat Party.

They might give the whole country back to the Indians. Why not? According to their ideology, America has no right to exist. They have been tearing down statues of Christopher Columbus and George Washington to underscore that very point. Maybe they will declare Elizabeth Warren an honorary Indian and appoint her Big Chief for Life.
