Video: Deputy Public Defender Unjustly Arrested

San Francisco, CA — San Francisco Public Defender Jeff Adachi today released video showing a deputy public defender being unlawfully arrested outside a courtroom as she attempted to protect her client’s right to counsel.

The cell phone footage, taken Tuesday afternoon inside the San Francisco’s Hall of Justice , shows San Francisco Police Inspector Brian Stansbury arresting Deputy Public Defender Jami Tillotson for refusing to let her client, a young African American man, be questioned without the presence of his attorney.

Stansbury, the subject of a 2013 federal civil rights lawsuit filed by a black SFPD officer alleging racial profiling, cites Tillotson for resisting arrest as a uniformed officer places her in handcuffs. Tillotson, an 18-year veteran of the San Francisco Public Defender’s office, remains calm and courteous throughout the video, telling Stansbury and five officers that she is representing her client and is not resisting arrest.

Officers took Tillotson to a holding cell in Southern Station, where she remained handcuffed to a wall for approximately an hour. After Tillotson was led away, Stansbury photographed and questioned her client and another young man who did not have an attorney present. Officers refused to tell the young men or Tillotson the reason for the detention.

“Public defenders have a duty to protect the constitutional rights of their clients,” Tillotson said at a noontime press conference Wednesday. “It was surreal to be led away in handcuffs for doing my job, something I do every day.”

Adachi called Tillotson’s arrest “outrageous” and “disappointing.”

“This is not Guantanamo Bay. People have an absolute right to have their attorneys present during questioning,” he said.

The Public Defender has requested a copy of the police report in the incident and has demanded both an explanation and an apology.

“A uniform does not give you a license to bully innocent people into submission,” Adachi said. “If this happens to a public defender in front of her client, I can only imagine what is happening on our streets.”

Tillotson then left the court room to inform her client that he did not have to answer Stansbury’s questions and that Stansbury had no right to be photographing him and his friend. Tillotson said her client was at the Hall of Justice for minor and misdemeanor cases of theft, which were unrelated to whatever Stansbury was reportedly questioning the client about.

“She was released from custody under penal code 849b, Esparza said, which usually means there is insufficient evidence for making a criminal complaint.

She was arrested for “reisting arrest” – how can you be arrested for resisting arrest unless they are already arresting you (for something else) that you would, supposedly, be “resisting”?? She was not being arrested at all. It was like, “let us question him and don’t inform him of his right, even thoguh we should be questioning him, and if you try to point that out, we’ll ‘arrest you for resisting arrest’)

S.F. public defender detained outside court; office outraged

A San Francisco deputy public defender was handcuffed and arrested at the Hall of Justice after she objected to city police officers questioning her client outside a courtroom, an incident that her office called outrageous and police officials defended as appropriate.

The Tuesday afternoon arrest of attorney Jami Tillotson as she denied police officers’ attempts to take photos of her client without explanation raised questions about police intimidation and harassment, Public Defender Jeff Adachi said at a Wednesday news conference.

But police said the five officers, led by a plainclothes sergeant, were investigating a burglary case in which Tillotson’s client and his co-defendant were considered persons of interest. Tillotson was cited for misdemeanor resisting or delaying arrest because she obstructed a police investigation, officials said.

“I was arrested for what we do as public defenders every day,” Tillotson said of the encounter, which was captured in a video that the public defender’s office posted on YouTube. “I asked questions. I talked to my client and explained to him his rights. At that point, I was told I was interfering and taken into custody.”

 
 

‘Simply doing her job’

Adachi said, “This is not Guantanamo Bay. You have an absolute right to have a lawyer with you when you’re questioned. Ms. Tillotson was simply doing her job.”

Tillotson’s client had just made an appearance in Department 17 on the second floor with a co-defendant for a misdemeanor theft charge when they left the courtroom and came under questioning by a plainclothes police officer at about 2 p.m., authorities said.

Other attorneys with the public defender’s office filmed the interaction, in which the plainclothes officer, Sgt. Brian Stansbury, told Tillotson, “I just want to take some pictures, OK, and he’ll be free to go.” When she declined his request, Stansbury said, “If you continue to do this, I will arrest you for resisting arrest.”

“Please do,” Tillotson responded.

“It was very clear to me that I hadn’t been doing anything illegal,” she said at the Wednesday news conference. “I was challenging him, telling him that you know that I know that I did not violate the law. He moved it forward.”

The video showed Stansbury continuing to take photos of the client and his co-defendant after Tillotson was handcuffed and led away, with Stansbury telling them, “Try not to move.”

Stansbury was one of three officers whose traffic stop of an off-duty black colleague in 2013 led the off-duty officer to file a federal civil rights lawsuit filed against the city. Police officials have said the officers involved had not engaged in racial profiling.

Tillotson was handcuffed to a wall in a holding cell for about an hour while Adachi contacted San Francisco Police Chief Greg Suhr and Deputy Chief Lyn Tomioka.

In an unprecedented incident, Deputy Public Defender Jami Tillotson was arrested and booked Tuesday on a misdemeanor resisting arrest charge for refusing to let a client of hers be questioned by a police investigator who was also trying to take pictures of the client, Public Defender Jeff Adachi said. But police Officer Albie Esparza countered that the investigator, who is a sergeant, acted appropriately and it was the sergeant’s duty to detain and question the man if he thought that he was of interest to an investigation. Esparza added that the officer had the right to arrest anyone who was obstructing an officer lawfully fulfilling that duty.

 

The arguments were made during dueling press conferences held Wednesday by the Public Defender’s Office and the Police Department in connection with the arrest of the deputy public defender.

 

Adachi charged that the arrest and conduct of the officer – identified as Inspector Brian Stansbury – were unlawful, and that he had no right to question Tillotson’s client without her being there.

 

 

Tillotson said her client was at the Hall of Justice for minor and misdemeanor cases of theft, which were unrelated to whatever Stansbury was reportedly questioning the client about.

Adachi presented a video at his news conference that shows the confrontation.

 

In the video, Tillotson’s client is shown in a blue shirt, with Tillotson standing between her client and his friend, who is not being represented by the Public Defender’s Office, outside a bathroom in the Hall of Justice.

 

The video begins with the inspector telling Tillotson that he just wants to take a few pictures and then “[the client] will be free to go.”

 

Tillotson counters that the two do not need their pictures taken.

 

Adachi noted that since the client is already involved in the justice system, police already have his picture on file.

 

As the video continues, Stansbury asks to speak with Tillotson and tells her it will only take two minutes. She then replies, “we’re OK here. We don’t need any pictures taken, thank you.”

 

Stansbury subsequently threatens to place Tillotson under arrest for resisting arrest, to which she replies, “please do.” And then he does.

 

Following her arrest, Tillotson was taken to the Southern Station where she was held for about an hour, Adachi said.

 

“It was surreal to be led away in handcuffs for doing my job,” she said.

 

Adachi was outraged by the arrest.

 

“This is not Guantanamo Bay,” he said. “If this happens to a public defender in front of her client, I can only imagine what is happening on our streets.”

 

Adachi has requested a copy of the police report, which Esparza said the department would provide.

 

Adachi has also called for an apology, but it is doubtful that one will be forthcoming, because police believe the sergeant acted lawfully.

 

According to the public defender, Stansbury was the subject of a federal civil rights lawsuit that was filed against him by another San Francisco police officer for alleged racial profiling, which is what Adachi has accused Stansbury of doing in the Hall of Justice Tuesday. The man he was trying to interview and photograph was African American.

 

It’s unclear if Tillotson will actually face charges in the case.

 

She was released from custody under penal code 849b, Esparza said, which usually means there is insufficient evidence for making a criminal complaint.

It still is an active criminal investigation, however, Esparza said.  “Time is on our side,” he said. Police Chief Greg Suhr is out of town and had no comment on the incident Wednesday

AVIRAM: “Regardless of where the constitutional disposition is, the attorney was in no way being violent or resisting arrest or being disruptive in any way. It’s extreme and it’s bad press for (the police). I’m surprised.”
