The Police in Santa Fe Attempted to Kidnap My Parents Dog - And I Got Cited For It

On the evening of February 26, 2018 at approximately 6:30pm I found an intruder standing in our private driveway with a gun and a leash, who later turned out to be someone from animal services. I immediately, and angrily demanded he leave the property at once, and insured both of my parents dogs were secured in the yard. I checked to make sure he had left, and stood watch as he sat in some vehicle at the bottom of our long driveway in an a manner in which our private driveway became blocked for exit, and after several minutes the police showed up to harass me. I wouldn’t allow them up without a warrant either, and since they were all intruders to me without any rights to be on our property I never offered my identification to them. However several days later I received a citation for violations I was not responsible for, and them having my information for the citation means they obtained it illegally and in violation of my 4th amendment rights, yet I’m the one being prosecuted in court.

I was later sent a citation by certified mail asserting that my dog was seen running around the neighborhood and I was being fined for no license, no vaccinations, mandatory spay/neuter, and obstruction at the tune of $375.00

In my defense of the allegations on the citation

A. I don’t own a dog

B. Both dogs I live with are properly licensed, properly vaccinated, and properly neutered, so obviously the animal in question isn’t one of the families.

C. There is no evidence to prove anyone’s dog was in violation of city ordinance. 

     (pursuant to section 104.109 of the United States Federal Law, any violation must accompany proof before it is issued. And pursuant to section 118.109-114 of the United States Penial Code any attempt to prosecute someone with insufficient evidence in any means shall themselves be prosecuted to the fullest extent of the law pursuant to title 112 of the United States Constitution which states “a person falsely prosecuting a person of a crime shall be punishable by life in prison.”)

Here are the violations committed against me, which I would insist on pressing charges for.

A. Citing someone for a crime without evidence is a violation of the law

B. Trespassing on private property is a violation of the law.

C. Trespassing on private property with a firearm is a separate violation of the law.

D. Trespassing on someone’s property without proper identification is a violation of the law.

E. Trespassing on someone’s property without a warrant is a violation of the law.

F. Calling the police on someone for lawfully removing you from their property is a violation of the law.

G. The police responding to the call is a violation of the law

H. The police trespassing on private property is a violation of the law.

I. Animal services attempting to apprehend an animal on its owners property is a violation of the law.

J. Animal service attempting to apprehend a family pet without a warrant is a violation of the law.

K. Illegally obtaining a persons information, especially to cite them for a crime they clearly didn’t commit is a violation of not only federal Law in regards to law enforcement officers, it’s a violation of our most protected rights, our 4th amendment rights to privacy. I never gave anyone my identification that night because none of them were acting within the confines of the law.
