Congressman Makes Inquiry About EEOC Rubberstamping in Civil Rights Case

      U.S. Congressman Ted Poe (R), TX, has sent an inquiry to the EEOC questioning its rubberstamping of a case closed on a Texas man who worked for a large nonprofit organization.  This comes after obtaining documents showing the employer lied to labor officials and the case was then quickly closed without anyone questioning employer witnesses.  Some of the documents are online now at the website http://stillsupremelyunjust.yolasite.com/

      The nonprofit organization involved is a large YMCA – one of the largest in the nation, where the alleged victim worked for over 8 years.  Claims of the victim ranged from repeated physical assaults in the workplace to threats, verbal abuse, reverse gender-discrimination and pay disparities, years of unpaid overtime, plus other claims of mistreatment.  One disturbing claim is said to be orders to commit race and gender discrimination in the hiring of workers for afterschool childcare programs licensed with the State of Texas.  While surprising to think it possible in a men’s organization such as the YMCA, there evidently were some email documents used as evidence in court which seem to support such claims. They, also, can be seen online, at http://supremelyunjust.weebly.com/email-evidence.html.

The supposed victim was never allowed a jury trial after trying to proceed as a self-litigating plaintiff, due to poverty, despite other documents apparently proving his YMCA opponent used perjurous testimony in court while proceeding to oust him via a motion for “summary judgment”, claiming the man didn’t have enough evidence to be in court.  The summary judgment motion seems to have been filed before the YMCA finished producing evidence ordered to a federal magistrate.  In fact, some of it has still not been produced for some reason, despite court orders.  However, the man, a Mr. Noack, seemed to have submitted a substantial number of other documents as evidence — some very disturbing! 

      The former claiment also indicated there was documented evidence that some newly hired women working parttime began work at a substantially higher wage than he himself,  although he had a good employment record, years of experience, substantial training, and was already a fulltime employee doing the same kind of work.  Mr. Noack had allegedly also submitted documents about such things to the courts, in his case.  Additionally, his being a fulltime employee there begs the question, “How was a fulltime employee with so much experience being paid less than two newly-hired parttime employees?”   Was it indeed because he refused to continue working unpaid overtime and ignored an alleged YMCA request to discriminate against men and african-americans, as Noack claimed in his lawsuit?

     

      Other evidence also shows signs of possible evidence-tampering as well as withholding of evidence — even court-ordered disclosures — and other likely legal improprieties.  Noack’s lawsuit was quickly dumped out of the legal system despite the 7th Amendment right to a jury trial for civil cases such as his and in the face of overwhelming federal law supporting his case against any motion for summary judgment, considering the amount and types of evidence involved.

      Congressman Ted Poe has decided there is enough evidence to merit an official inquiry, so something must smell like rotten fish in this matter, as Rep. Poe has a good reputation.  He also seems to be willing in this case to consider the potential wrongs suffered by african americans although being a Republican Congressman.  Interestingly, it also turns out that Mr. Noack, himself, is caucasion.  What an interesting case this could be, yet I’m loathe to see it in any of the national news media for some reason, despite the amazing documents seen showing stamps as court-coded, powerful evidence.

      The possible victim in all this has now been living in tents for several years due to the catastrophic results of it all.  There is mention online that he has lost his new car – repossessed, lost his professional and state certification and license, and that there is a fund that has been set up for small $1 donations in hopes of gaining enough support for new jobskill education or training of some sort.  That site can be found at https://www.wepay.com/donate/91753

      A focus-page on a site called Supremely Unjust (http://supremelyunjust.weebly.com/) gives other info and links, including about how to help Mr. Noack elsewise and a link to an online petition for govt action.  At least 4 judges were shown to have allowed documented perjury in their courts against him.  The overall testimony the YMCA itself used against Noack to put him out of court seems to consist only of YMCA officials and two alleged witnesses, one being his supervisor who supposedly was involved in the purported discrimination and the other being a coworker whom documents indicate perjured herself against him.
