Phoenix, AZ—The Phoenix Police Department personnel records of former detective Armando Saldate or rather certification of the destruction of them was filed in U.S. District Court today by the Arizona Attorney General. I have examined them carefully. Unless there is a dispute over the actual record or certifications with Debra Milke’s lawyers this will pave the way for an order by Judge Robert C. Broomfield sending the Milke case back to the Maricopa County Superior Court.
I do not anticipate any dispute or additional hearings regarding the documents or lack thereof. I think I can safely presume that Milke will be removed from her Death Row cell and transferred to the Maricopa County Jail sometime before the end of this week. She will be quickly brought before a judge for a status conference.
The bad news for Milke is that the jail food is especially terrible even when compared to what she was getting on Death Row. Hopefully she won’t be suffering with that very long before she’s cleared and released. We still need to learn just what Maricopa County Attorney Bill Montgomery has in mind to resolve this matter. Considering he does not even have minimal probable cause now to retry Milke, I suspect he has little choice but to free her.
