No matter what political position I’ve had, and no matter where I find myself debating, I still see a lot of pro-irresponsibility being the platform for what some believe as “freedom.”  Though I understand compassion & empathy.  I understand that wanting to help others is a good thing.  But one thing that I do not think is healthy, be it in business or in personal lives, is restricting things based on a general welfare of the people.  I know that sounds cruel.  “He doesn’t want people to be well? He’s crazy!!”  That’s not what I mean.  Let me try to go piece by piece through what I mean using a hot-button issue:

Contractual Agreements

Due to the state of the US Government & their corporate ‘sponsorship,’ a lot of completely unfair contracts are being enforced by our judicial system.  However, even though the contracts themselves are unfair, I think that anyone should still be allowed to enter into them.  Anyone should be allowed to make the poor choice to sign a contract that they don’t understand.  Or even a contract that is deliberately worded to mislead the signee & trick them into a bad situation.  Jeeze, I’m sounding downright tyrannical now aren’t I?  Or am I?  Because I believe you should be free to make a poor decision?   The problem here isn’t the contracts, it’s the judge, jury, & enforcer of these contracts.  Ooops, I put jury in that last statement.  That shouldn’t be in there.  Seeing how 90%+ cases never even make it to the judge (let alone a jury) & end in settlement instead.  Usually, the guy w/ the most expensive lawyer or lawyers comes out ahead.

Similar to the gun control debate, the ability to contract isn’t to blame, it’s those who are framing their contracts with the intent to place the signee into a situation that they almost certainly would NOT want to be in, had they known the intent of the contractor.  These days, we’ve all seen Terms of Use Agreements & blindly clicked on them.  Maybe you’ve read some of them & clicked even though you didn’t agree or like the terms.  But you really wanted to use the product or service, & figured “eh, so what?”  And signed anyway.  In all honesty, it’s almost impossible to live your life completely devoid of having taken some part in one of these ridiculously long & hard to understand agreements.  Unless you’re truly attempting to stay off the grid (but we all know that’s not very many people).

Contracts are a big issue these days especially due to the NSA & PRISM because a completely ‘legal’ & ‘agreed to’ accumulation of personal data has FINALLY caught main stream attention with your average American.  (Having said that, please inform your fellow man about it just in case they haven’t heard about it).  I say legal & agreed to because everyone did in fact agree to have all their information compiled & sent off wherever the corporation wants to send said data.  When?  How?  In the Terms of Use Agreement.  If you want to use Facebook, you first have to agree to their terms.  Which most people just do automatically as if it’s like a “are you sure you want to install this software” button after you put the disc in the drive & told your computer to install the software.  Just using Facebook is the agreement.  If you didn’t agree, then you wouldn’t use Facebook!  The only problem there is that Americans have completely gotten used to the absence of real freedom of choice.  The whole “Coke or Pepsi” duopoly scenario.  So, because there’s no alternative, you just click ‘ok’ & use the product/service.  Well, what else are you gonna do?  NOT be on Facebook!!!!????  Yes.  I’m not on Facebook.  Because I don’t agree.  But even so, my information is still being gathered.  At some point, something I agreed to had some kind of verbiage in it that allowed it to be so, no matter what the situation might be.  But hey, if you don’t like it, don’t worry.  You can probably file a complaint & participate in Mandatory Arbitration.  Which, I’m sure that the Arbitration company that a huge corporation like Facebook would choose will be completely fair & unbiased in every way.  In no way will the Arbitration company side with whichever party is likely to keep using their Arbitration business.  Nope.  It’s not in the Arbitration company’s best interest to… oh I don’t know… DO MORE BUSINESS.
