Phoenix, AZ—I was waiting for this to happen the moment Maricopa County Attorney Bill Montgomery announced his intent to retry Debra Milke for Capital Murder.

I had serious concerns that Montgomery was unethically attempting to retry a case lacking any legitimate probable cause. Montgomery also indicated he is intending to let disgraced former detective Armando Saldate commit perjury once again despite knowing he had massive credibility issues.

These exceedingly serious conflicts of interest should have caused Montgomery to simply drop the case or remove himself from any future proceedings. I can’t imagine any legitimate reason for Montgomery to have not to have stepped aside. The corrupt odor of Montgomery’s efforts is overwhelming.

Montgomery should have simply ended the nightmare. Instead the top prosecutor took the low road. To me it’s no more than an obvious attempt to cover up serious wrongdoing by a bad cop and people within the prosecutor’s office.

Milke’s lawyers Mike Kimerer and Lori Voepel have filed a Motion to Disqualify the Maricopa County Attorney as the prosecutor. Extreme circumstances were cited along with a compelling case that financial reasons also color the prosecutor’s motives. If they can’t win a second conviction, past and present employs of the office could be on the hook for civil damages.

The Ninth Circuit U.S. Court of Appeals in their 60 page opinion that had reversed the convictions and death sentences also had referred the conduct of cops and prosecutors for investigation by the Justice Department.

If the Maricopa County Attorney’s Office were to stay on the case they would be able to manipulate files, witnesses and evidence in a way to cover up their unethical or even criminal behavior. That motion can be seen below:
