Maricopa County Attorney Bill Montgomery is Truly a Soulless Bastard!

Phoenix, AZ—Yesterday Phoenix lawyer Larry Debus came into the courtroom of Judge Rosa Mroz. Debus made it very clear that his client, the disgraced former police detective Armando Saldate will refuse to testify at the redo-capital murder trial of Debra Milkebecause of self-incrimination issues.

All along Prosecutors claimed that Saldate was cooperating and was once again going to testify under oath that Milke confessed to him. When did the County Attorney’s office know that Saldate made it clear he would hire a lawyer and assert his privilege under the Fifth Amendment? The report below shows in April Saldate was avoiding prosecutors and their investigator! Bill Montgomery’s claims of ignorance here ring hollow and don’t pass the smell test.

Saldate is no stranger to taking the Fifth while under investigation. It was just two years ago that he hired a lawyer and refused to answer investigator’s questions about a felony sex extortion allegation while employed as a constable. He simply agreed to resign and the case was dropped.

Montgomery apparently knew Saldate was ducking investigators seeking his cooperation but instead he misled news reporters and the court about Saldates intentions.

Montgomery’s motive was simply to terrorize Debra Milke into entering into a plea in exchange for being released for time already served in prison. If Milke knew Saldate was not going to testify prosecutors would never get her to plead guilty.

What this really reflects is that Montgomery seriously lacks integrity and is certainly no more credible than his star witness, Saldate.

Today Montgomery’s press aide Jerry Cobb announced a press conference to talk about the Debra Milke case. I wanted to attend this and other press briefings on the Milke case but have been barred along with members of the European press that were covering this story. The reason is very clear because the foreign press and I have asked far too many questions about this troubling death penalty case. Cobb even told me I was biased today! I must confess, I am biased in favor of the simple truth!

At Montgomery’s press briefing he accused Judge Mroz of witness tampering by appointing a lawyer to represent Saldate so his rights were not violated! He accused the defense lawyers too saying their tactics were frightening Saldate away from the witness stand.

Aside from legitimate self-incrimination issues Montgomery should realize that Saldate’s lies have taken a toll on him too. Saldate is a Catholic and I doubt very much that he wants this terrible sin to follow him throughout eternity. At the same time Saldate does not want to go to prison for this serious crime.

Montgomery lashed out at the Ninth U. S . Circuit Court of Appeals today but since review was not sought in the Supreme Court their ruling is the law of the land. Montgomery’s statements are disrespectful, outrageous and unprofessional. Montgomery wants to take the law into his own hands. Today Montgomery actually passed out copies of Judge Robert C. Broomfield’s reversed legal decision like it was somehow the law!

When public officials take the law into their own hands violating our constitution it is nothing less than government tyranny. Montgomery has placed himself far above the law and accordingly it’s time for the defense to re-urge the disqualification of Montgomery’s office from this case.

Montgomery cannot be trusted as a public official because he’s violated his oath and is maliciously seeking to murder Debra Milke under color of law. The time has come for people that see things as I do to make complaints to the Arizona State Barbecause of Montgomerys ethical failure in this matter.
