Court Rules: No More 4th Amendment In Pennsylvania

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

For many of us, the 4th Amendment seems so obvious that it is insane that anyone could miss it’s meaning.  Tell that to Pennsylvania Supreme Court Justice Seamus McCaffery.

According to lancasteronline.com, McCaffery made a court opinion that in the state of Pennsylvania, police no longer need a warrant to search a persons vehicle.  Now, based on the opinion, it only takes reasonable probable cause for an officer to go ahead with a search without a warrant or the owners consent.

“The prerequisite for a warrantless search of a motor vehicle is probable cause to search,” McCaffery writes in the opinion. “We adopt the federal automobile exception… which allows police officers to search a motor vehicle when there is probable cause to do so…”

McCaffery is siting the federal automobile exception that allows officers from the FBI, ATF and other unconstitutional alphabet soup agencies the right to search a persons vehicle without consent or warrant.
