Donald Trump vs Joe Biden and your rights

Now that Joe Biden has been nominated and Kamala Harris is nominated as his VP, it is time to take a look at what is really going to count in this November’s election.

Personally, I like Joe Biden, he is a good all around person and liked by many. I have also liked Kamala Harris but things have changed some in that respect. President Donald Trump is gruff and boisterous. The current Vice President, Mike Pence, does not present a remarkable presence and even today is not a universally recognized  household name.

However, these are not what we should be looking at when selecting a president and Vice President.

What we need is a president that is going to keep our country what it is supposed to be, to keep our individual and personal rights safe and unfettered. We need a president who is not beholden to anyone except the people that elected them. This is also true of our other elected officials, Governors, Senators, and Representatives. We need these people to make the laws that provide for the needs of the American people and to keep us safe.

In the Bill of Rights, the First 10 Amendments to the US Constitution, there are a number of Rights that are elucidated. It should be noted however, that the Constitution does not grant these rights, it only specifies that these rights shall not be either abridged or infringed. In other words, these Rights may not be taken away, reduced, or limited by the government.

Among these rights are Free speech and freedom of press, meaning that we not only have the Right of sharing our thoughts through both speaking and through the written word, but that we also have the right to read and hear what others may have to say, the Right to peaceably assemble. This does not include any right to riot nor to impose the will of one group upon another through force or oppression. Among these rights is also the right to freely worship or to have a religion. The first amendment most vehemently states and supports these rights as well as the right to Redress off Grievances. While some may not like it, it is the free exercise of religion that May Not be prohibited in any way.The founding Fathers made it clear in their other writings that these Rights were and are “endowed by their Creator with certain unalienable Rights”. The government is not allowed in any way to limit these Rights. In the past, certain members of the Supreme Court have raised interpretations over the Right to freely worship by referring to other letters and documents that are not a part of the Constitution and do not have a direct relation to the Constitution. One such idea is the ‘separation of church and state’ which is NOT in the Constitution. The Constitution simply states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof” which means that the Supreme Court has imposed rules upon the people that Congress has been barred from doing. For this reason, the rulings from the Supreme Court that were based on this idea should be ruled Unconstitutional in themselves.

I would like to note here that the reason that certain rights are listed in the First Amendment is that the Founding Fathers considered them to be of paramount importance. It is also notable that the Second Amendment states “the right of the people to keep and bear Arms, shall not be infringed.” There are several reasons for this. The most important one is that our nation had just secured its existence through ‘armed rebellion’ and that these arms belonged to individual citizens. Without the private militias of the day, we would have had no chance of becoming a free nation. For this very reason, the Second Amendment to the US Constitution INTENDED that the general population be able to arm themselves sufficiently well to overthrow an oppressive government as well as to provide for their own private security.

The Fourth Amendment explains that “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” I will bring this up again as it has current relevance.

The Fifth Amendment specifies that “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury,  … nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”

Amendment 6 – Right to Speedy Trial, Confrontation of Witnesses. “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.” I will also revisit this Amendment because it has significant relevance.

Amendment 8 – Cruel and Unusual Punishment.
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Amendment 9 – Construction of Constitution.
“The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” What this means is that while certain rights may be listed, the listing of those rights do not outweigh the rights of others. This means that while you may have “freedom of speech” you may not use that right to injure others or to wrongfully deprive them of what is rightfully theirs. It also means that other rights may exist that are not listed in these Amendments. This is the part of the Constitution that has decided many cases as it enforces the “right to make personal private choices and the right to choose not to do things”. Basically, it has been used to interpret the right of an individual to have control over personal decisions about their own body, examples being the right to personal private choices of a sexual nature as well as the right of a woman not to be forced to carry a child. This Amendment precedes and has precedence over the 10th Amendment as does the other First 8 Amendments. The Founding Fathers framed the Bill of Rights this way.  

Amendment 10 – Powers of the States and People. The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

So, what is the point to all of this?

The point is that, especially in this election, you need to vote for the party and the individuals that secures your Constitutional Rights. If you do not, You WILL lose at least some of those rights if not all of them over time.

There are two parties that have any significance in the US and they are generally at opposing sides of the scales. So, let’s break this down.

Free speech and freedom of press. While not official government, there is a movement to block the opinions and ideas of certain groups of people. This goes so far that even much the media that we count on to keep us inform is providing distorted information, rather than providing fair and impartial information, are presenting so called experts that are in reality providing opinions with sometimes hidden agenda, sometimes, quite overt.When it comes to having a press or media that is daily telling lies to their viewers, it is time to take pause. The left has taken the stance that only those with an agreeing opinion is allowed to express such opinions.
 
The right to peaceably assemble is a valuable ability but it does not include the right to loot and destroy and this has been occurring in excess. This is exceedingly common among certain groups and has appeared largely in certain cities, mostly those where the democrats are in charge. If you see who these groups are, whatever their agenda, it should not be supported.

The right to freely worship or to have a religion is being suppressed and an anti-religion is being promoted by one political party. When a political party responds to religious aspirations such with loud and resilient booing, it is time to look at that party with a sharp eye. This is in addition to the fact that the Democrat Party has completely left God out.

The left has long been pushing an agenda against the right to bear arms. We should never forget that it is this right that supports and shields all of the other rights. The loss of this right would insure that the other rights could be easily removed. It is exactly what the left has been pushing for for many years.
 
It is a recent event that the democrats in the House of Representative threw out right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause by using falsified and doctored information to present a case of impeachment against our President Donald Trump. It is one thing to have hearings but when it comes to presenting false information and passing judgment based on opinions and non-evidence, this is basically treasonous. The truth is that if they could Impeach a President based on lies and innuendo, they could do the same to anyone, including you.

In the long run, I do not see the Democratic Party, Joe Biden, Kamala Harris, Nancy Pelosi, or any Democrats fully supporting the US Constitution, especially the Bill of Rights.

      The ninth amendment is NOT referring to abortions! They didn’t even have abortions back then. Besides, while a woman may have the right to do to her own body what she wills, she does NOT have the right to harm the baby inside her! That baby is ANOTHER human being, not the mother! Abortion, therefore, is murder of ANOTHER human being. The mother isn’t killing herself. She’s killing another human being. And we’re in this mess because of judicial activism. Maybe our founders should have provided relief for that. Maybe they did. They only issue “opinions.” If the states are unhappy with their opinion they have recourse. Look it up.

      Social Media is denying one group of people their constitutional right to freedom of speech. The government should not allow that because the government is responsible for securing our rights. No company should be legally allowed to deny anyone their freedom of speech – politically or religiously. They can control which topics are not allowed but if a topic is allowed ALL members have a first amendment right to express their opinions without censorship.

      Social media today is influencing the outcome of an election and that is the problem and it affects an entire nation. That is why the government should intervene.
