Sydney Powell blasts Sanctions Hearing, denied fair process in fight for her career

Detroit served up some of its street justice and laid claim to the scalp of one Sydney Powell, Lin Wood and her fellow election litigants. We knew within minutes of the start of the hearing the intent was claiming her law license and her bucks. But this was not about Sydney and her fellow litigants. Its about dishing out a lesson that in the future no lawyer dare to be willing to take on election fraud cases. After all, just look east toward New York and what happened to Rudy

Powell and Wood’s co-counsel Stefanie Junttila, Scott Hagerstrom Julia Haller, Brandon Johnson, Howard Kleinhendler, and Gregory Rohl are also in attendance, by court order.

Their lawyer Donald Campbell and his co-counsel Patrick K. McGlinn.

Detroit’s lawyer David Fink is there with his partner and son, Nate Fink. The best I can determine he is Detroit’s hired gun. Apparently the city attorneys were not up for the task.

I did spend the more than six hours watching this kangaroo court. You will perhaps see clips of it here and there. But nothing can prepare you for watching decent honorable people get the shaft and have to sit there and endure the idiotic claims made by attorney David Fink. As well as judge Linda Parker. The fix was in.

None of the evidence was then or now has received or is receiving an evidentiary hearing.

An evidentiary hearing is a legal court proceeding that involves eyewitness testimony, given under oath, that’s relevant to the case. The presiding judge will hear and take into consideration live eyewitness evidence presented during the hearing in order to make a fair ruling.

In other words, zero interest in the facts and merits of the case.

EnterJudge Linda V. Parker

Judge Linda V. Parker was nominated by President Barack Obama to the United States District Court for the Eastern District of Michigan on July 25, 2013 and confirmed by the United States Senate on March 12, 2014.

Judge Parker served on the Third Judicial Circuit Court in the County of Wayne from December 2008 until her appointment.

A native Detroiter, Judge Parker is a former director of the Michigan Department of Civil Rights, a position in which she served from 2003 until 2008. Judge Parker is a former partner of the Detroit-based law firm, Dickinson Wright, PLC, and served as the first Executive Assistant U.S. Attorney for the Eastern District of Michigan in the US Attorney’s Office from 1994-2000.

How did we get here? There were numerous court actions following the election. It was easy to lose track or importance of this one.

Sydney Powell, Lin Wood: Requested injunctive relief.

Law and Crime:

Slapping down one of the so-called “Kraken” cases pushed by pro-Trump lawyers Sidney Powell and Lin Wood, a federal judge in Michigan cut off one of the arms of their efforts to overturn battleground elections.

Although a complete evisceration of the lawsuit’s legal theories and evidence, the ruling addresses only one of its requests: denying an injunction purporting to decertify the election.

At the heart of their lawsuit—filed in the names of six Michigan residents, led by Timothy King—was an idea that the judge found antagonistic to the nation’s democratic experiment.

As for the supposed fraud claims, the judge noted they are “an amalgamation of theories, conjecture, and speculation that such alterations were possible,” emphasizing that last word in original.

“With nothing but speculation and conjecture that votes for President Trump were destroyed, discarded or switched to votes for Vice President Biden, plaintiffs’ equal protection claim fails,” the ruling states.

After identifying so many defects in the lawsuit, Judge Parker suggested that the goal of the pro-Trump attorneys was not to win but to destabilize democracy in the United States.

The only defect identified and actually adjudicated was the Judge’s claim that it was filed too late. Zero to do with the facts or witnesses or merits of the case.

Enter one Attorney David Fink the star plaintiff in the case today:

Detroit’s attorney David Fink said in an email that the “frivolous” suit deserves sanctions.“

It’s a good day for democracy; not such a good day for frivolous Republican lawsuits,” Fink wrote.

This was not David Finks first rodeo. He had been chasing after sanctions elsewhere without success.

Law and crime:

“Few lawsuits breathe more lies than this one,” Fink wrote on Wednesday of a different lawsuit filed by Trump’s former lawyer Sydney Powell. “The allegations are little more than fevered rantings of conspiracy theorists built on the work of other conspiracy theorists. Plaintiffs rely on affidavits of so-called ‘experts’—really confidence men who spread lie after lie under cover of academic credential—which misstate obviously false statistics.”

Fink previously—and unsuccessfully—sought to sanction pro-Trump lawyer Mark F. “Thor” Hearne II for lying that he was only withdrawing a separate election lawsuit because Wayne County’s Board of Canvassers refused to certify the result. Both the state and the county certified the results, but the judge shrugged off the pro-Trump falsehood as heated rhetoric of the historical moment.

On Thursday, Judge Kenny did not appear likely to grant the invitation to punish the lawyers behind the case, either.

The city has called the Trump campaign’s endgame a “court-ordered coup d’état” in a legal filing and has been the lonely voice requesting that judges sanction their opponents for what the city’s lead attorney David Fink plainly describes as a campaign of “lies” and “frivolous” litigation.

The fury and indignation behind the Detroit’s litigation came to a head at a remarkable hearing on Thursday afternoon, where Fink dressed down his opposing counsel David Kallman as an emissary of a racist and anti-democratic idea.

“The motion, while frivolous, serves a purpose,” Fink remarked, referring to Kallman’s request for a post-certification audit—focusing on his majority-Black city and diverse Wayne County.

July 12, 2021: The court action begins. Judge Palmer hammers the gavel:

Enter Sydney Powell and her rat friend Lin Wood that was more than happy to jump the ship and leave her twisting in the wind and holding the bag. He don’t know nothing about anything and has no recollection of anything either.

“For whatever reason, whoever filed the complaint put my name on there,” Wood said. “I didn’t have any specific involvement.”

David Fink:

Fink, representing Michigan’s largest city, drew direct connections between the Michigan lawsuit and the Jan. 6 insurrection at the U.S. Capitol. “Because of the lies spread in this courtroom, not only did people die on Jan. 6, but many people throughout the world … came to doubt the strength of democratic institutions in this country,” Fink said Monday.

The defense was not permitted a response though tempers flared in an attempt to indicate this was beyond the scope and unmerited without proof.

The only point of the judge’s efforts yesterday was going over a number of affidavits that were included in the pleadings and as Sydney said, they were not even required in the filings. The judge shook her head in agreement. Over 900 pages of evidence including statistical and expert statements. They requested an evidentiary hearing including the sworn testimony in the affidavits under attack. Of course that was a moot point. The attack alone was on the affidavits of witnesses. 

It is becoming clear. The judiciary in this case has now joined forces with the Democrats. How one judge can determine the fate of an attorney when she clearly has a bias beyond imagination. But that is what we are doing now isn’t it? Reimagining… in this case it has reached the federal judgeships. Weep for America. I feel incredibly sad.

This story is buried by the Cuba insurrection for one, as well as CPAC, by conservative news outlets which makes it only more distressing. While we are losing America, Cubans looks towards us.

Facing potential financial sanctions, Powell refused to relent. She said “the duty of lawyers” was to raise “difficult and even unpopular issues.”

“We have practiced law with the highest standards,” Powell said. “We would file the same complaints again. We welcome an opportunity to actually prove our case. No court has ever given us that opportunity.”

During Monday’s sanction hearing, Powell said she had practiced law for 43 years and “never witnessed a proceeding like this.” Powell also criticized David Fink, the attorney for the city of Detroit, who is among the individuals seeking penalties for those who attempted to reverse the election, and the proceeding itself.

“This is one of the proceedings that leave the American public with no confidence either in our election system or in our judicial system,” Powell said.
