A portion of the secret recording between Brian D. Hill (USWGO Alt. News), Brian’s family, and Attorney Fred Smith reveals that attorney Fred Smith did believed Brian Hill was innocent of his state misdemeanor charge on September 21, 2018, after reviewing over why Brian was charged with contempt of court by Judge Greer of the Martinsville Circuit Court. This attorney had reviewed over why Brian made accusations against Judge Greer when he filed his motion to vacate the fraudulent begotten judgment, proving that he was not medically cleared at the time of his arrest (lab work was deleted form the chart) and that the arresting officer admitted that Brian was not obscene as required by law while he believed that lab work was done by the hospital. Later investigation disproved that officer’s beliefs as the lab results were ordered then were covered up, deleted from the medical chart at the time of Brian’s arrest. It was covered up. Brian’s attorney Fred Smith did betray Brian and had lied to the asst. Attorney General Justin Hill in Virginia. He did however acknowledge that Brian Hill was innocent of his original charge but gave Brian the bridge to nowhere in the corrupt commonwealth court system. They knew they convicted an innocent man but they don’t care because they are sociopaths at best, they don’t care how FAKE their criminal records are. Even though this attorney messed up Brian’s appeals, the same recordings have this same attorney admitting (without knowing that he was being recorded since one party consent is all that is needed to legally record a conversation) that his client is INNOCENT OF HIS CHARGE. This Attorney admitted to it by acknowledging this fact by asserting that his client should file a defective petition for a writ of actual innocence, and even the Attorney General in-a-way had admitted to this as well. It is defective because the corrupt Virginia legislature did not provide any legal mechanism for innocent people wrongfully convicted of misdemeanors to be exonerated.

There you go. The cover up of Brian’s lab tests being ordered has been proven. Says: “The following items were deleted from the chart.” They covered up any notion of conducting lab tests. WHY???

Attorney Fred Smith did give his opinion to Brian and to Brian’s family that Brian is innocent of his 2018 charge, but he gave the advice that Brian file a petition for the Writ of Actual Innocence. The only problem was that Brian did that and he had failed because the Virginia law only allows those petitions for felony convictions and not a misdemeanor conviction. See Hill v. Aug. 1, 2022) (“Hill then filed a Petition for Actual Innocence with the Court of Appeals of Virginia, which was dismissed on March 1, 2022, for lack of jurisdiction because the actual innocence statute applies only to felony convictions.”). Brian is innocent, attorney admits to that according to the conversation in the secret recording, but the law does not cover misdemeanor convictions. Then Attorney Fred Smith said that it was the law as if convicting an innocent man or woman of a crime is A-Okay, but convicting innocent people is wrong, morally wrong to convict an innocent person of any crime. It is not the law to convict an innocent person of a crime because it is FRAUDULENT. That is contradictory to what punishing somebody for committing a crime is all about. Convicting an innocent person for a crime is contrary to law and ethics. It isn’t justice at all, it is punitive. Punishing in an innocent person for being unlucky in the criminal justice system. Even though this lawyer has been proven to be a traitor and a liar to wreck Brian’s appeals, even that traitor acknowledged the fact that Brian is innocent of his charged crime. It is time for the attorney games and trickery to end. Brian must be pardoned now. Lawyers involved in both sides of Brian’s criminal case seem to be good liars and good tricksters.

See, it ain’t just our words. Attorney Fred Smith said multiple times that Brian should file a petition for the writ of actual innocence even though that petition only is applicable to felony convictions and does not legally apply to misdemeanors. Attorney Fred admitted Brian is innocent in the secret recording Brian recorded between him, Brian’s family, and that traitorous lawyer.

Even the Assistant Attorney General had not claimed Brian had proven no fraud at all, maybe they did, but they mainly argued that Brian had not proven EXTRINSIC FRAUD. So even they know that fraud was used to convict this innocent man. Brian proved his criminal conviction was obtained by FRAUD but rather the Attorney General argued that it was INTRINSIC FRAUD. It’s all mind games, psychological games, gaslighting, and stack the cards against the innocent person.
