New York City Mayor Zohran Mamdani is locked in an aggressive legal and political battle with property owners over his newly enacted pied-à-terre tax and his radical block-by-block housing plan. The freshman Democratic mayor, who took office in January 2026, has positioned himself as an adversarial force against high-value real estate, drawing fierce backlash from landlords, billionaires, and middle-class primary residents caught in the crossfire.

A centerpiece of Mamdani’s “tax the rich” platform, the city passed a massive annual surcharge targeting luxury second homes. It imposes a levy of up to 1.3 percent on single-family homes valued over $5 million, and up to 6.5 percent on condos and co-ops valued at over $1 million. The tax is expected to bring in $500 million annually to patch the city’s budget deficits.

To roll out the tax, the city published an annual tax roll database containing the names and addresses of over 900,000 property owners online. Critics and high-profile targets like hedge fund billionaire Ken Griffin called the move a security risk that targeted homeowners for harassment.   The city sent out warning notices to 17,000 residents stating they may owe the tax. However, thousands of these notices were sent erroneously to people using the properties as their primary residence. The administration placed the burden of proof entirely on the homeowners to upload tax returns, driver’s licenses, and utility bills to prove they do not owe the tax.

Represented by prominent attorney Randy Mastro, a coalition of New York homeowners filed a lawsuit to halt the rollout. On August 10, 2026, a Staten Island judge issued a temporary restraining order blocking the tax administration. However, the Mamdani administration immediately appealed, and an appeals court lifted the roadblock days later, keeping the tax on track while full oral arguments loom for August 31, 2026. Due to the uproar, Mamdani extended the initial exemption application deadline to September 18, 2026.

The conflict extends beyond luxury second homes. As part of Mamdani’s socialist-aligned housing strategy, his administration has threatened to seize private real estate from building owners deemed “bad landlords”. Under this block-by-block housing initiative, properties that fall into deep disrepair or face continuous city code violations will be forcibly transferred away from private owners and turned over to tenant cooperatives, non-profits, or community land trusts. Real estate advocates and local opponents have heavily criticized this plan, arguing the administration is weaponizing the building department to fine landlords into insolvency so the city can confiscate their property
